IN FAVOR: Ron Williamson representing Jerome Nonn <br /> IN FAVOR: Norm Esser <br /> OPPOSED: None <br /> DANE COUNTY HIGHWAY LETTER: Don Walker, no objection. <br /> TOWN BOARD: H. Hoffman, Chairman no objection. <br /> #441. IN FAVOR: Norbert Schahte <br /> OPPOSED: None <br /> town BOARD: Not present <br /> The Public Hearing was closed. <br /> #426. Motion by Voges second by Dahlk to hold in abeyance. Motion <br /> carried. <br /> #431. Motion by Dahlk second by Voges to grant variance of 27 feet from <br /> required setback from centerline for residence and a variance of 15 <br /> feet from required setback from centerline for the garage. Also, a <br /> variance from ordinance requirement permitting only one accessory <br /> building on a parcel as per finding of fact: <br /> 1. Existing residence is non-conforming. <br /> 2. There will be no external additions to residence. <br /> 3. Existing residence is structurally sound. <br /> 4. Garage was built with understanding from Town Board that no <br /> permits were required. <br /> 5. Garage is set back 14 feet farther than the residence. <br /> 6. Existing shed is too small for a garage and too good to tear down. <br /> CONCLUSON: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance necessary to provide rights enjoyed by others. <br /> C. Variances are not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #432. Motion by Voges second by Dahlk to grant variance from ordinance <br /> requirement that a residence located in a flood plain area shall have the <br /> first floor or basement constructed on fill at or above the flood pro- <br /> tection elevation as per finding of fact: <br /> 1. Existing residence is not in the flood way. <br /> 2. Addition, to comply with ordinance, would split residence into <br /> two levels making it impractical. <br /> CONCLUSION: <br /> A. Ordinance is creating an impractical hardship. <br /> B. Variance is not contrary to public interest or rights of others. <br /> Motion carried. <br /> #433. Motion by Dahlk second by Voges to grant variance of 23 feet 6 <br /> inches from required setback from center of road as per finding of fact: <br /> C <br />
