BOARD OF ADJ. MINUTES CONTINUED: <br /> PAGE 3 <br /> 1. Addition will not extend farther out than the existing steps <br /> and basement entry way. <br /> 2. Proposed entry will eleminate water leaking into basement. <br /> 3. Proposed entry will provide much better protection from elements <br /> and will prevent heat loss. <br /> 4. Road is straight in this area - no danger increase to motorists. <br /> CONCLUSION: <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is not contrary to the public interest or rights <br /> of others. <br /> Motion carried. <br /> #434. Motion by Voges, second by Dahlk to hold in abeyance. Motion <br /> carried. <br /> #435. Motion by Voges second by Dahlk to deny variance request as per <br /> finding of fact: <br /> 1. Mr. Holmes had requested a-variance for addition to residence <br /> (#304 9/20/74) which was granted. <br /> 2. Mr. Holmes constructed the porch, in question, without required per- <br /> mits or consultation with Zoning Department. <br /> 3. Porch is so constructed that use of adjoining property must be made <br /> to gain outside access to porch. <br /> CONCLUSION: <br /> A. The hardship was self-imposed as Mr. Holmes was aware that <br /> variance and permit were required before. Motion carried. <br /> #436. Motion by Dahlk second by Voges to grant variance of 21 feet <br /> from required rear yard as per finding of fact: <br /> 1. Existing residence was built when required rear yard in A-1 <br /> district was 35 feet. <br /> 2. Additional land to the rear could not be purchased.as it would <br /> encroach into farm land. <br /> CONCLUSION: <br /> A. Unnnecessary hardship. <br /> B. Variance required to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #437. Motion by Voges second by Dahlk to grant variance of 6 feet <br /> from required setback from front property line as per finding of fact: <br /> 1. The allowable two foot addition would not be practical. <br /> 2. Addition to left side of residence is impossible because of <br /> garage and driveway. <br /> C <br />
