Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #438. No action; applicant did not appear. <br /> #439. Withdrawn <br /> #440. Motion by Dahlk second to grant variance of 24 feet from required <br /> setback from front property line as per finding of fact: <br /> 1. Setback problem is caused by extra-wide right-of-way for County <br /> Highway and a steep slope upwards of the terrain. <br /> CONCLUSION: <br /> A. Unnecessary hardship. <br /> B. Variance necessary to provide right enjoyed by others. <br /> C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #441. Motion by Voges second by Dahlk to grant a variance of 9 feet from <br /> required rear yard as per finding of fact: <br /> 1. Error was due to constractors mistake. <br /> 2. Other residences in area have 35 foot rear yards as they were <br /> built when the plat was zoned A-1 and required only a 35 feet rear <br /> yard. <br /> 3.
