A different location would require removal of trees and plantings <br /> 2, No objection from County Highway Department or Town Board <br /> Conclusion: A. Case of unnecessary hardship. <br /> B. Not contrary to public interest or rights of others-. <br /> Notion carried. <br /> #359. Motion by Dahlk second by Voges to grant a Special Exception <br /> Permit to fill and a variance from setback requirements as per finding <br /> of fact: <br /> 1e Existing residence is non-conforming. <br /> 2. Bathroom cannot be installed inside residence because of poured <br /> slab foundation. <br /> 3. Ordinance requires fill to depth of 787.9' for human habitation. <br /> Conclusion: A.
