-2- <br /> Minutes of Board Adjustment 3/21/75 <br /> IN FAVOR: G. Yelk; purpose is to prevent flooding of fields by: 1. <br /> cleaning out the existing ditches. 2. Construction of paralled ditches <br /> to drain fields. 3. Construction of three ponds as shown on map into <br /> which new ditches will drain. t . Construction of a bank or dike <br /> between existing ditches and new ditches to prevent flooding. There <br /> will be no connection between the new ditches and ponds with the <br /> existing ditches. The ponds will be pumped into the existing ditches <br /> when necessary. The ponds will be a minimum of one acre in size and <br /> will be dug as deep as is possible. Mr. Yelk presented a letter from <br /> D.N.R. stating no permit was required for the work as was explained to <br /> them. <br /> OTHERS IN FAVOR: None Opposed: None Town Board: Not present <br /> Communication: Telephone call from D.N.R. expressing concern, <br /> because, from Zoning Department notice to them, the work proposed <br /> was more extensive than they realized. <br /> The Public Hearing was closed. <br /> #340. Notion by Voges second by Dahlk to grant the Special Exception <br /> Permit as per the following instructions: <br /> 1. Building must be firmly anchored to prevent floating away in case <br /> of flood. <br /> 2. Any electrical or heating installations must be above the flood <br /> protection elevation. <br /> Motion carried. <br /> #341. Motion by Dahlk, second by Voges to grant variance of bOr 2," <br /> from required setback as per finding of fact: <br /> 1. Existing residence is non-conforming <br /> 2. Proposed work will not extend farther into setback area. <br /> 3. There was no objection from the State Highway Depatnent. <br /> Conclusion: <br /> A. Proven unecessary hardship. <br /> B. Variance is not contrary to public interest or to rights of others. <br /> Motion carried. <br /> #342. Notion by Voges second by Dahlk to hold in abeyance until the <br /> Public Hearing of April 18, 1975. <br /> Motion carried. <br /> #313. Motion by Dahlk second by Voges to grant Special Exception <br /> Permit for proposed work subject to D.N.R. and Drainage District #9, <br /> requirements. Motion carried. <br /> Motion by Dahlk, second by Voges to authorize per-diem and mileage <br /> for sub-committee meeting on March 13, 1975 for Mfr .
