MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MMTING OF OCTOBER 18, 197L <br /> Present: Erickson, Dahlk, Voges <br /> Also: Enger, Fleck <br /> Meeting was called to order at 7:30 P.M. by Chairman Erickson to conduct <br /> a public hearing as published in the notice. Motion by Dahlk, second by <br /> Voges to approve minutes of September 20 & October 12, 1974° Motion <br /> carried° <br /> The notice was read and the Public Hearing was opened. <br /> #31140 IN FAVORS Mrs. Felts and her attorney, Atty. Tom Swoboda. Variance <br /> is requested to allow repair to residence. Sewer is being installed in <br /> area and so a bathroom will be added. Upkeep of residence was neglected <br /> because of Mr. Felt's automobile accident, and Mrs° Felts poor health. <br /> A petition, signed by 13 neighbors in favor, was presented. Atty. Swoboda <br /> requested permission for a witness to testify on the condition of the <br /> structure; granted. Edward G. Bruns, Ag° Eng. Dept., Univ. of Wis., Farm <br /> Building Construction (includes homes); visited residence in question, it <br /> is a very satisfactory structure to repair, examined it from top to bottom. <br /> OTHERS IN FAVOR: Ron Jordick and Tom Francis were employed to paint the <br /> residence; not professionals,but found the surfaces were sound with no wea. <br /> ness° Some of the damage was due to vandelism° <br /> OPPOSED:, M. Layman and Atty. Feifarek. Presented a petition with 22 sig- <br /> natures requesting the Town Board of Westport to declare the Fehr s resid- <br /> ence a nuisance dated August 1t, 1974° Intent is to show that residence is <br /> a nuisance; feel that residence has been left to delapitate; type of re- <br /> pairs suggested will still leave building a hazzard to neighborhood; belie - <br /> it is not in keeping with the intent of the ordinance. It is implicit with <br /> the law, that buildings have to be kept in a good state of repair and State <br /> Statute, chapter 66, provides they can be removed if they are not. <br /> Question: Erickson; has the Town Board been requested to condem the build <br /> ing? Layman; yes, 5 years ago and again last July° Atty. Feifarek; what <br /> precipated the repair work was a letter to Felts from the Town Atty0Bucaid: <br /> presented for the record, which stated complaints had characterized the <br /> building as a nuisance in the nature of a fire and health hazzard and sug- <br /> gesting that if they were amenable to demolition, should be accomplished <br /> through the Fire Department° Otherwise there would be no alternative but <br /> to inform the complainants to file formal complaints° Layman; repairs <br /> such as jacking up the floor supports have been done since the "Stop Work" <br /> order was placed by the county. <br /> TONN BOARD: Kennedy, Tierney, and Shepherd: had Nathan Enge, Town Building <br /> Inspector look at the house; porches need to be repaired or replaced, The <br /> petition presented by Layman, contained some signatures by people who did <br /> not realize it was for the purpose of removing the residence and had calle« <br /> the Town Board to explain this fact. The letter sent by Bucaida was word- <br /> ed more strongly than was intended. Intent of Town Board was to repair the <br /> .residence, not to tear it down. The area has become a year-around resid- <br /> ential area and Town Board is interested in having it kept-up. Suggest <br /> that a reclamation plan for the residence be required to show intent - a <br /> coat of paint and some new windows, do not constitute a complete job. Town <br /> Board is not opposed to variance if it is contingent to being repaired <br /> properly. <br /> Fred Reemisch requested to speak: granted; feel that it is important to <br /> note that vandelism was in no way responsible for the condition of the <br /> residence and that the inference was improper. <br />
