(3) <br /> MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF SEPTEMBER 20, 1974 <br /> Cor #313. Appeal by Edward Fankhauser for A Special Exception Permit to con- <br /> struct a drainage ditch in the 1h of the $E , Section 33, Township of <br /> Rutland. <br /> IN FAVOR: Ed Fankhauser. The existing ditch was cleaned this year and <br /> included three farms to the South. The proposed hook-up will be made on <br /> the Fankhauser property. <br /> OTHERS IN FAVOR: None OPPOSED: none TOWN BOARD: Not present. <br /> The public hearing was closed. <br /> #303. Motion by Voges, second by Dahlk to grant variance of 4' from <br /> required setback as per finding of fact. 1. Proven case of unnecessary <br /> hardship. 2. Variance is necessary to secure for the applicant rights <br /> enjoyed by others. Motion carried. <br /> #304. Motion by Dahlk, second by Voges to grant variance of 20' from rear <br /> yard requirement as per finding of fact. 1. Proven case of unnecessary <br /> hardship. 2. Variance is necessary to secure for the applicant, rights <br /> enjoyed by others. Motion carried. <br /> #305. Motion by Dahlk, second by Voges to deny appeal; applicant did not <br /> appear at the hearing. Motion carried. <br /> #306. Motion by Dahlk, second by Voges to grant Special Exception Permit <br /> ith the following conditions: <br /> 1. Structure will be firmly anchored to foundation with bolts. <br /> 2. Electrical and heating facilities will be located at or above the <br /> flood protection elevation. (approximately 5' above grade at this <br /> location). Motion carried. <br /> .•308. Motion by Voges, second by Dahlk to grant variance of 4' from side <br /> ' ard as per finding of fact 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to secure for the applicant, rights enjoyed by <br /> ethers. Motion carried. <br /> 309. Motion by Voges, second by Dahlk to grant variance of 32 less spaces <br /> rom required parking with the following conditions: <br /> 1. If nature of business changes (increased traffic flow), parking facilit <br /> must be increased. <br /> 2. A deed restriction must be provided which will require that parking <br /> facility must be brought up to dode if the property is sold. Motion <br /> carried. <br /> 310. Motion by Dahlk, second by Voges to grant Special Exception Permit <br /> o dig drainage ditch if: 1. All necessary permits are applied for as <br /> .rovided for by statute. Motion carried. <br /> •311. Motion by Dahlk, second by Voges to grant 16'4" variance from shore- <br /> land setback as per finding of fact 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to secure for the applicant, rights enjoyed by <br /> others. Motion carried. <br /> 312. Motion by Dahlk, second Voges to hold in abeyance for at least 10 <br /> days. Motion carried. <br />
