Town Board has no objection if a deed restriction is required pro-
viding that if the property is sold, parking would have to be brought
up to code.
#310. Appeal by Maurice O'Brien, Merlin Marshall, and Daniel O'Brien, fo
a Special Exception Permit to construct a drainage ditch in the SW`4 SW14
of Section 35, Township of Oregon.
IN FAVOR: Maurice O'Brien, Merlin Marshall, Daniel O'Brien, and Atty.
J. Winter. Proposed ditch will drain approximately 108 acres of land,
which was good crop-land until two years ago. The proposed ditch will
connect with an old existing ditch located on Merlin Marshall's land. It
is the contention of Atty. Winter that the old ditch was part of a sanit-
ary district which had expired. Question: Is any extensive work requir-
ed to prepare the old ditch for the proposed drainage? A. Alme, contract
or; it is not absolutely necessary to improve the old ditch, it is handl-
ing the natural flow from this area at present.
OTHERS IN FAVOR: None OPPOSED: None
Atty. Arthur May, representing the Carl Raemisch property owner whose lan.
is crossed by the old drainage ditch. Mr. Raemisch has no objection if
proper procedure for hook-up is made through Circuit Court. Atty. May
insisted the drainage district was valid and effective.
William Wendt, Clerk of the Union Drainage District, questioned any hook-
up without proper procedure.TOWN BOARD: L. Anderson, Supervisor, if
question on legalities can be resolved, the Town Board is in favor.
#311. No addition to the build
ing is planned.
OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present
#312. Appeal by Blaney Farms Inc. for a variance from size requirements
of directory signs as provided by Section 10.4.2 (1) (a) of the Dane Count
Zoning Ordinance. Signs will be located in the E1/2 NE3, Section 14,
Township of Fitchburg.
IN FAVOR: Ed Blaney, large signs are required because:
1. Distance of plant off of highway is great.
2. Only way to identify location to the public.
3. Smaller signs would not be adequate for the speed of the highway.
4. Other businesses in the past have been permitted similar signs which
we are now prevented from having.
5. A compromise of one large sign farther off the highway with one small
sign would not be objectionable.
OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present.
