MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT
MEETING OF DECEMBER 20, 1974 Page 1
Present: Erickson, Dahlk, Voges. Also: Enger, Fleck.
Meeting was called to order at 7:30 P.M. in Room 226 by Chairman Erickson
I to conduct a Public Hearing as published in the notice. Motion by Voges,
second by Erickson to approve the minutes of November 15 and December 14,
1974; carried.
Notice was read and the Public Hearing was opened.
#325. Appeal by Midland Builders, Inc. for a variance from side yard
requirements as provided for by Section 10.06 (6)(a) of the Dane County
Zoning Ordinance. Variance is necessary to permit construction of a
residence on Lot 25, Western Hills, Township of Fitchburg.
IN FAVOR: Mr. David Crocker, President of Midland Builders; error was made
in location by basement contractor, it was not intentional; the right side
yard is over what is short on the left side. The residence on the left
has only a 10 foot side yard, therefore, land could not be acquired to
rectify the error.
OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: not present.
#326. Appeal by Arnold Willis for a variance from side yard and Shoreland
(setback from water) requirements as provided by Section 10.07 (6)(a) and
10.17 (7)(d) of the Dane County Zoning Ordinance. Variance is necessary to
permit construction of a deck addition to a residence located on part of
Lots 4 & 5, Morris Park, Township of Dunn.
IN FAVOR: Arnold Willis; The Bruce Company, Middleton, Wis. was contracted
to landscape the lot. The old 4' wide deck was torn down to facilitate
grading for proper drainage and the new deck was begun. Bruce Co. is not
familier with building requirements and did not obtain the proper permits.
Question, Dahlk; for your purposes does the deck have to be 10 feet wide?
Willis; not necessarily, we could utilize a 4 foot deck. Deck or stairway
access is necessary for main entrance which is about 10 feet above grade.
OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: not present.
#327. Appeal by Raymond P. Zweifel for a variance from setback requirement.
as provided by Section 10.17 (2) of the Dane County Zoning Ordinance.
Variance is necessary to permit construction of an addition to a garage
located on Lot 4, Block 14, Paoli, Township of Montrose.
IN FAVOR: R. Zweifel; addition will provide room for larger cars and for
storage. The 18 foot garage has been in existence for 30 years or more.
OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: letter stating no
objection. COMMUNICATION: Dane County Highway, D. Walker; suggested that
addition be restricted to rear of garage if possible.
#328. Appeal by Thomas and Barbara Haig for a Special Exception Permit to
construct a pond adjacent to Vermont Creek in the SGT, SE 1/4 of Section-t7-
Township of Vermont.
IN FAVOR: Mr. and Mrs. Haig; Question, Erickson; are plans for your pro-
posed pond being worked out in cooperation with S.C.S.? Mr. Haig; yes they
are. Pond will be at approximately the same level as the creek, no spill-
way is being proposed. Purpose is to provide 6-8 acres of land which can
be utilized for crops and to provide fishing, wildlife area and fire pro-
tection. High water table will supply pond, banks will be seeded with
heavy root grass to prevent erosion, etc..
OTHERS IN FAVOR: none. OPPOSED: none. TOWN BOARD: not present.
