DANE COUNTY BOARD OF ADJUSTMENT - 2 - May 17, 1974 <br /> #283. Alfred Lenz; appeal for a variance from setback requirements of the <br /> Dane County Zoning Ordinance, Section 10.17 (2). Location: CTH "V", <br /> SE4 SE4, Section 4, Township of Windsor. <br /> 16IP IN FAVOR: A. Lenz, pole type machine shed was constructed with the <br /> .., understanding that the required setback was 63' from centerline of <br /> CTH !'V". Building cannot be reduced in size or moved farther back on <br /> property. <br /> OTHERS IN FAVOR: None. OPPOSED: None. TOWN BOARD: Chairman Erickson, <br /> board is in unanimous favor. <br /> #281 . Cherokee Park Inc; application for a Special Exception permit to <br /> construct an accessory building in the flood plain. Location: Part of <br /> the SE4 NE4 of Section 24, Township of Westport. <br /> Cherokee Park, Inc. requested withdrawal of petition. <br /> The Public Hearing was closed. <br /> #278. Motion by Dahlk, second by Holte to grant 1.' variance from side <br /> yard and 9' variance from setback, as per finding of fact'. Carried. <br /> FINDING OF FACT: <br /> 1. A variance preserves the zoning ordinance as far as possible without <br /> injustice to the individual. <br /> 2. Must be proved necessary in order to secure for the applicant the <br /> rights that are enjoyed by other property owners in the area. <br /> 3. Variance is not contrary to public interest or rights of others. <br /> #279. Motion by Dahlk, second by Holte to hold in abeyance to allow time <br /> for Mr. Mikkelson to verify moving of sign. Carried. <br /> #280. Motion by Dahlk, second by Holte to grant variance of 10' from <br /> setback as per finding of fact. Carried. <br /> FINDING OF FACT: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Unique conditions. <br /> 3. Must be proved necessary in order to secure for the applicant the <br /> rights that are enjoyed by other property owners in the area. <br /> 4. Variance is not contrary to public interest or rights of others. <br /> #281. Motion by Dahlk, second by Holte to grant variance of 10' from <br /> required yard, as per finding of fact. Carried. <br /> FINDING OF FACT: <br /> 1. A variance preserves the zoning ordinance as far as possible without <br /> injustice to the individual. <br /> 2. Unique conditions. <br /> 3. Variance is not contrary to public interest or rights of others. <br /> #282. Motion by Dahlk, second by Holte to grant Special Exception Permit <br /> with special instructions that the building must be firmly anchored by <br /> bolts set in concrete and any electrical and/or heating service must be <br /> installed above the flood protection elevation. <br /> #283. Motion by Holte, second by Erickson to grant 12' variance from <br /> setback as per finding of fact. Carried. <br /> FINDING OF FACT: <br /> 1. Proven case of unnecessary hardship. <br /> 2.
