_ <br /> • <br /> MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF MARCH 10, 1972 <br /> tor The Dane County Board of Adjustment met on March 10, 1972 at 7:30 P. M. <br /> in room 226 (Circuit Court, Branch IV) to conduct a Public Hearing as <br /> published in the notice. <br /> • <br /> Present: Erickson, Holte, Dahlk <br /> Also: Enger, Fleck, Glen Henry • <br /> The meeting was called to order. Motion by Dahlk to approve the <br /> minutes of February 18 and March 4, 1972, second by Holte, carried. <br /> The notice was read and the Public Hearing was opened. <br /> ✓ #167 Appeal by Bernard Shomberg from denial of a permit to construct a <br /> sixteen unit apartment building on Lot 7, Belmar, Township of <br /> Fitchburg. Permit denied as lot area will permit only a fourteen unit <br /> apartment under the Dane County Zoning Ordinance. <br /> In favor: Bernard Shomberg presented site plan; proposed construction <br /> of two 16 unit apartment buildings on separate lots, 7 and 8 of Belmar, <br /> but combining the lot areas to provide adequate area to meet the re- <br /> quirements of the ordinance. R. Stauber, architect for Shomberg requested <br /> that if appeal were denied, wouldn't it be possible to have two 15 <br /> unit buildings. Richard Holt owner of proposed buildings, stated that <br /> reason for the appeal was to enable economically feasible buildings, for <br /> himself and the community to be built. <br /> Opposed: None <br /> COMMUNICATIONS: Letter from Charles Dinauer, Planning Directory, City <br /> of Madison opposed to granting of appeal on the basis there was no <br /> hardship, setting of a dangerous precedent and property directly across <br /> the street, under City Zoning, had not been allowed to increase densities <br /> beyond what is permitted. <br /> Letter from Don McGaw, Supervisor, Town of Fitchburg stating Town <br /> Boards opposition to granting of appeal. Shomberg in reference to setting <br /> a precedent; these are the last lots in area - no more apartments can be <br /> built. There have been no objections from neighbors. <br /> TOWN BOARD: Don McCaw, Supervisor opposed as per letter. <br /> ✓ #168 Appeal by the Town Board of Cottage Grove and Olger Graff in, a <br /> resident landowner of Cottage Grove, as to the interpretation of the <br /> Dane County Zoning Ordinance relative to the definition of "Single <br /> Family Dwelling" as used in Section 10.05 (1) (a) of the ordinance. <br /> IN FAVOR: Lloyd Schneider, Attorney for Town of Cottage Grove and <br /> D. Graffin: only relevant consideration is the interpretation of the <br /> Zoning Supervisor as to "single family dwelling". Concern is over <br /> permitting emotionally disturbed children into the Town of Cottage Grove <br /> and other Dane County areas with no notice. "Single family" is usually <br /> a, father and a mother raising their own family. Browndale is proposing <br /> to hire professional people as a father-mother image to "rear" these <br /> emotionally disturbed children. As interpreted, the single family <br /> residence is not subject to zoning or site approval or to the State <br />
