Rezone petition 5587 is an application to provide appropriate <br /> zoning for 12 parcels recently created by a circuit court in <br /> an estate settlement. The attached composite report map shows <br /> the property layout and the Final Judgement document shows how <br /> the property was divided. The heirs were not provided with <br /> any contiguous parcels. Jim Burke, husband of Arlene S. <br /> Burke, has been up to your office and has spoken with Peg <br /> regarding this matter. <br /> QUESTIONS: <br /> If parcels are created by court decree is the county required <br /> to provide appropriate zoning for said parcels? If not, what <br /> is the use status of said parcels, can they be utilized as <br /> separate buildable lots? <br /> REFERENCES: <br /> Sections 10. 123 (1) (B) , 10. 123 (2) , 10. 123 (3) (b) , 10. 123 (5) (a) , <br /> 10. 123 (5) (b) , 10. 123 (9) (a) , 10. 123 (9) (b) , Dane County Code of <br /> Ordinances (DCCO) . <br /> 2 . Please see Section 10. 123 (2) (b) DCCO. The ZNR Committee has <br /> set up a site plan review to assure compliance with the <br /> ordinance, copies of the procedure, etc. are attached. <br /> QUESTION: <br /> Does the committee also have to take into consideration Town <br /> Land Use Plans or is their decision to be based only on the <br /> provisions in 10. 123 (2) (b) ? <br />
