2664 Oak Crest Circle <br /> • Sun Prairie, WI 53590 <br /> March 18, 1993 <br /> Chairman Lyman Anderson <br /> Zoning and Natural Resources Committee <br /> Dane County Zoning Department <br /> Room 116, City-County Building <br /> Madison, Wisconsin 53709 <br /> Dear Chairman Anderson: <br /> On February 9, 1993, I was one of six residential property owners <br /> attending the Zoning and Natural Resources Committee (Committee) public <br /> hearing in strong opposition to Zoning Petition #5557 by Barbara <br /> Heinemann to rezone RH-4 Rural Homes to C-1 Commercial and RH-3 Rural <br /> Homes. I am opposed to this rezoning request in general, but specifi- <br /> cally against the commercial rezoning of residentially zoned land to <br /> allow the construction and establisherabnt of a communications repair <br /> shop on a portion of Section 32, NE SE Town of Sun Prairie , located at <br /> 4545 Cty Trk Hwy TT. My objection to the petition as well as that of <br /> the 30 property owners who signed the petition submitted to you at the <br /> 2/9/93 hearing is that by setting a precedent it would encourage addi- <br /> tional commercial encroachment of residentially owned property in a rural <br /> residential area. Neither I nor any of the petition signers have any <br /> objection to the Heinemanns development of a commercial activity which <br /> would enhance their profits. Such and endeavor is understandable and <br /> laudable as long as it is accomplished on established commercially zoned <br /> land. The petitioners and I believe that it does not have to be and <br /> should not be accomplished at the expense and detriment of our family <br /> residential neighborhood. <br /> After Mr . Bernie Heinemann, representing the petitioner, presented <br /> the details of petition #5557 at the 2/9/93 hearing, answered some ques- <br /> tions put to him by the Committee , I was given an opportunity to state <br /> the rationale for my opposition and pointed out a few facts not covered <br /> by Mr. Heinemann. The other five residential property owners in the im- <br /> mediate neighborhood also spoke in opposition of petition #5557. =Lr. <br /> Heinemann was then permited a rebuttal statement. After hearing Mr . <br /> Heinemann make certain untrue statements, I recuested to speak again, but <br /> was informed that the ground rules precluded my speaking again. However, <br /> I was invited to submit my additional comments in writing. I am taking <br /> this opportunity to submit my comments to you and the Committee. <br /> 1. Mr. Heinemann stated to the Committee that no commercial work <br /> activities of any kind were being conducted at his 4545 Hwy TT residence . <br /> As a neighbor who walks and drives past the Heinemann property 3 to 4 <br /> times each day,I believed his statement to be untrue . In my verbal state- <br /> ment to the Committee I had mentioned that the Heinemann residence was <br /> the only residence in our entire area to place a large commercial dumpster <br /> along with overflow container s on the shoulder of Hwy TT every 'Monday for <br /> pick up by BFI Waste Systems on Tuesdays. The dumpster was usually loaded <br /> to the hilt with metal tubing, pipes, angle iron, metal sheeting, etc. , <br /> etc. protruding above the dumpster. in his rebuttal, a Committee <br />
