That it is not illegal to utilize a dumpster ; and <br /> c. The dumpster was only put out once a month. <br /> It is regrettable that kr. Heinemann was not asked what the contents <br /> of the dumpster were and, of course , he did not volunteer that information. <br /> It is noteworthy, however , that he did state that they never put out gar- <br /> bage or recycableslIt To me the dumpster contents were a clear signal that <br /> this was scrap materials from the commerical antenna activities being car- <br /> ried on at the Heinemann residential property. Mr. Heinemann is a sub- <br /> contractor for Evans Industrial Communications, Inc, , 4902 Pflaum Road, <br /> Madison. <br /> Although other neighbors can also atteat to the weekly presence of the <br /> dumpster along Hwy TT, the frequency of BFI dumpster pick-ups per month is <br /> really not important. However , BFI Waste Systems, 3083 County Trunk i,iE, <br /> Madison, would be able to provide some interesting details and data. <br /> Furthermore , John Norwell, Dane County Highway Commissioner , has ap- <br /> prised me that placing a commerical dumpster on the shoulder of any County <br /> Trunk Highway is illegal. He stated that locating such a dumpster on the <br /> shoulder of Hwy TT would be considered a road hazard and no Street Permit <br /> for the utilization of a dumpster in that manner would ever be issued. <br /> Since the Heinemann' s commercial dumpster was utilized on 2/8 to <br /> 2/9/93 and mentioned to the Committe on 2/9/93 , the dumpster has not been <br /> placed on the shoulder of Hwy TT of the Heinemann property. <br /> 2. In order to endeavor to establish whether commercial activities <br /> were indeed taking place on the Heinemann residential property, I observed, <br /> during the work-week of March 1 - 5 , 1993, from about 7:30 A. . to 9: 30 <br /> A. a. each day, the comings, goings and activities that I could observe <br /> taking place in back of the Heinemann home and in and around the adjacent <br /> building located behind the home . I did this to obtain a pattern of activ- <br /> ities by the Heinemanns and their workers. I was able to observe the back <br /> yard and adjacent building, apparently a portion of which at least is being <br /> utilized as a work shop, from the south ridge of Hwy TT which is consider- <br /> ably higher than the Heinemann property located on the north side of Hwy TT <br /> with the aid of binoculars. What I observed was that workmen (Mrs . B. <br /> Heinemann told neighbors in her canvass of the neighborhood on 3/6 and 3/7/ <br /> 93 , that they have 6 workmen) began to arrive between 7:45 and 8:10 2,.M. as <br /> a rule. A period of bustling work activity would ensue outside , within and <br /> around the adjacent building for anywhere from 30 minutes to one hour or <br /> longer (I would depart at 9 :30 A .-M. after the most obvious work activities <br /> had ceased. <br /> Having thus satisfied myself that work-related activities were indeed <br /> taking place , the next logical step was to have a Dane County Official as- <br /> certain whether my conclusions were properly founded. The Dane County <br /> Zoning Department was apprised of the possible non-compliance by the <br /> Heinemanns of activities restricted for a residential property. Inspector <br />
