I am a bit
confused with some wording and have 3 questions below:
For the past several days, I have been searching for the amended wording which pertains to the requirement of a location survey if a single
family/residence foundation is placed closer than 20'to a side yard. The information below was taken from the Dane Co. Zoning-Title 2a
Chapter 10:Zoning-Subchapter I General Zoning which states 10'or more a survey is not required. For our records and to make sure that our
project is in compliance with zoning regulations, could you please forward the 20'or less requiring a location survey. I'm wondering if I'm getting
confused with the definition of set back and/or lot line and that is where the extra 10'are coming from. We were verbally told 20'or less would
need a location survey, but need the written legal information for our construction project binder. It is a priority for us to have a complete survey
performed regardless, however need the clarification.
(3) Inspections of buildings to be made by the
zoning administrator. (a) 1.A location survey as
defined herein shall be submitted to the zoning
division for all construction which will be located
less than 10'from required setback lines. The
survey shall be done at the time when
foundations or basement walls are completed.
Such survey shall be submitted to the zoning
office prior to the continuation of work on the
project.
2. For construction which is located 10'or more
from the required setback lines,a location survey
is not required. The property ownerls and
contractor/s are responsible for determining
location compliance.
Regarding residential single family zoning of RH-1,chapter 10.09 which talks of Permitted Uses 10.09(1)and Conditional Uses 10.09(2). For
Conditional uses 10.09(2) it states that a conditional use permit is required.
If our business falls under the RH-1 Permitted uses/home occupation category, meeting the zoning requirements,do we still need to file for a
conditional use permit? According to my interpretation of the wording,we do not, however need verification/clarification. We do have a family
home business of 20+years, however relocating our home within the next 2 years to RH-1 Photography, minimal foot traffic, appointment basis,
no retail. For Permitted use/home occupation,do we need to install handicap bathroom facilities in our home?
Q1: Need clarification in writing regarding needing a location survey if less than 20'
Q2: For RH-1 Permitted Use is a conditional use permit needed
Q3: Do we need to install a handicap bathroom
Please let me know if you need further information. I greatly appreciate your help and assistance.
Sincerely,
Toni Skala
(608)839-1700
skalapix(aacharter.net
Information above taken from-Zoning- Title 2a Chapter 10.'Zoning-Subchapter I General Zoning
5/14/2009
