Coe <br /> testified before this Board that they believe eve the value of their lands will be <br /> diminished by the construction and operation of a prison in the area. In addition, <br /> those testifying expressed fears for their personal safety in the event a prison is <br /> allowed in the Town of Albion. While these statements are not pertinent to the <br /> main issue here, they are pertinent to show that CAP is an aggrieved person. We <br /> believe that it is reasonable for the members of CAP to have these fears and we <br /> believe that a broad and liberal construction of the term "aggrieved person," <br /> should be made in order to give some avenue of relief for these people. Obviously, <br /> the statute was written to obtain an impartial review of decisions which might <br /> adversely affect the citizenry. A narrow construction of the statutes should not <br /> be utilized to thwart that obvious purpose. As a further ground for this Motion <br /> to Dismiss, the State urged the Board to find that the actions of the Zoning <br /> Administrator in accepting an application for a conditional use permit to convert <br /> St. Joseph ' s Seminary to a prison was not a "decision" as the term is used in <br /> Section 59.99 (4) , Stats . , and Section 10.26 (3) (a) , Dane County Ordinances . We <br /> believe that the actions of the Zoning Administrator were the results of a decision <br /> that he made, namely, that prisons are a conditional use in the A-1 Exclusive <br /> Agricultural District. Conversely, we believe that the Zoning Administrator is <br /> empowered to reject applications for conditional use permits where he believes the <br /> Ordinance does not allow a conditional use. That is also a decision and is also <br /> subject to appeal under Section 59.99 (4) , Stats. , and Section 10.26 (3) (a) , Dane <br /> County Ordinances . By Section 10.25 (1) , Dane County Ordinances , the Zoning Admini- <br /> strator is charged with the enforcement of the Zoning Ordinance and his actions in <br /> accepting or rejecting applications for conditional use permits or other permits <br /> certainly constitute decisions which are reviewable by this Board. <br /> Cie As a further ground for the Motion to Dismiss , the State argues that the <br /> Zoning Committee has exclusive jurisdiction to determine whether a correctional <br /> institution is permitted in an A-1 Exclusive Agricultural District as a conditional <br /> use. It is true that the Zoning Committee is the only body which can grunt a <br /> conditional use under the Dane County Zoning Ordinance. However, the question of <br /> whether or not a conditional use should be granted to allow the conversion of St. <br /> Joseph 's Seminary to a prison in the Town of Albion is not the question before this <br /> Board. The question before this Board is whether, in any part of the A-1 Exclusive <br /> Agricultural District, prisons are a permitted use. This Board has absolutely no <br /> power to grant a conditional use permit anywhere in Dane County. By our decision <br />
