Motion by Schwahn, second by Purcell to grant a variance of 2 <br /> feet from the required setback from So. Koshkonong Drive . <br /> FINDING OF FACT: <br /> 1. Addition is in line with the existing non-conforming residence <br /> and will not encroach farther into the setback. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> d. Hardship is caused by the Ordinance and is not self-imposed. <br /> Motion carried. <br /> #849. Motion by Voges, second by Schwahn to grant the special exception <br /> permit with the condition that the project be reviewed by A.S.C.S. and <br /> be subject to their recommendations. <br /> FINDING OF FACT: <br /> 1. Project is necessary to provide drainage for 7-8 acres of land <br /> which has become too wet for spring planting. Motion carried. <br /> (11", #850. Motion by Kruschke, second by Voges to grant a variance of 27. 5 <br /> feet from required setback from normal highwater line. <br /> FINDING OF FACT: <br /> 1. Cellar door with foundation is closer to water. <br /> 2. Area is existing non-conforming residences as pertains to setback <br /> from water. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #851. Motion by Voges, second by Purcell to grant a special exception <br /> permit to fill and grade within 300 feet of the normal high waterline. <br /> FINDING OF FACT: <br /> 1. Fill was needed to support new sea wall and improve shoreline. <br /> 2. Fill is no higher than adjacent lots and existing slopes and boat <br /> ramps will control run-off. <br /> Motion carried. <br /> #852. Motion by Voges, second by Schwahn to grant a variance of 1.7 feet ] <br /> from required side yard. <br /> FINDING OF FACT: <br /> 1. Problem is caused by ordinance requirement that accessory building , <br /> pools, etc. must be farther than 10 feet from the rear line of the <br /> house, (rear line includes steps, decks, etc. ) to be less than <br /> 10 feet from side lot line. <br /> - 3 - <br />
