BOARD OF ADJUSTMENT - Minutes <br /> October 25, 1979 <br /> Page 7 <br /> 2. Deck and stairway is necessary to permit second entrance to resi- <br /> dence. Other residences in the older developed area are as close, <br /> or closer, to the water. <br /> 3. Deck can be built on left side of residence without a variance by <br /> reducing deck width. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #839. Motion by Kruschke, second by Schwahn to grant a variance of 10 <br /> feet from the required setback from Morris Park Road and a variance <br /> of 5 feet from required right side yard. <br /> FINDING OF FACT: <br /> 1. Slope of lot from road down to lake is very severe preventing a <br /> complying setback without extensive fill and retaining wall con- <br /> struction. <br /> 2. Location of existing stairway prevents side yard compliance of gara;e. <br /> 3. Neighbor and others in the area have been granted similar variances <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> IL, c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #840. Motion by Purcell, second by Voges to grant a variance of 365 space_ <br /> from total required parking granted with the following conditions: <br /> 1. During tent sales, additional parking equal to the number of spaces <br /> displaced by the tent, shall be provided. <br /> 2. Hiring of parking patrolmen shall be continued to alleviate illegal <br /> parking, traffic congestion and blocking of traffic. <br /> FINDING OF FACT: <br /> 1. Required parking is based upon total retail sale area; a substan- <br /> tial part of this area will be utilized for display of merchandise <br /> and could not be occupied by patrons. <br /> 2. Required parking would accomodate over 800 customers; type of busi- <br /> ness does not generate this many customers at one time except for <br /> special sales ie: "tent sale". <br /> 3. New building was planned to provide area for larger and better <br /> displays of merchandise and not necessarily for more customers. <br /> 4. American TV will provide additional parking during tent sales and <br /> employ parking patrolmen to alleviate parking problems. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br />
