Building can not be enlarged in any manor without a variance. 5. This entire area has many similar non-conforming buildings be- cause of shallow lots, steep grades, etc. and variances have been granted to permit additions and even new buildings. CONCLUSION: a. Proven case of unnecessary hardship. b. Variance is necessary to provide right enjoyed by others. c.1. Variance is not contrary to rights of others or to the public interest. Motion carried. #772. Motion by Dahlk second by Krushchke, to grant a variance of 3 feet 11 inches from required setback from C.T.H. "Y", a variance of 12 feet 11 inches from required setback from St. Dominic Street and a variance of 2 feet 6 inches from required rear yard. FINDING OF FACT: 1. Many residences along C.T.H. "Y" in this area are non-conforming as to setback. Variances have been granted for some for addi- tions, etc. CONCLUSION: a. Variance is necessary to provide right enjoyed by others. b. Variance is not contrary to rights of others or to the public interest. Motion carried. #773. Motion by Purcell second by Schwahn to grant the Special Excep- tion Permit as proposed with maximum fill height at 851.5 feet U.S.G.S. datum. FINDING OF FACT: 1. High water table necessitates on grade or surface basement. Fill is necessary to bring grade up around basement walls to a reason- able depth. 2. Fill will not be in a flood zone area and seeding or sodding will prevent erosion and siltation. SPECIAL INSTRUCTIONS: 1. Fill shall be seeded with fast growing grasses or sodded to prevent erosion or siltation. 2. Inspection by Zoning Department shall be requested when fill project has been completed.
