BOARD OF ADJUSTMENT - Minutes <br /> P.H. May 24, 1979 <br /> Page 4 <br /> 4111" #768. Motion by Purcell second by Voges to grant a variance of 38 feet <br /> 6 inches from the required setback from center of unnamed town road. <br /> FINDING OF FACT: <br /> 1. Proposed building will be farther back from road than existing <br /> buildings. <br /> 2. Low marshland and flood zone prevent construction farther away <br /> from road. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #769. Motion by Voges second by Purcell to deny requested variances <br /> and grant a variance of 35 feet from required rear yard and 5 feet from <br /> required right side yard. <br /> FINDING OF FACT: <br /> 1. There is ample open area to construct proposed garage somewhat <br /> away from lot lines in order to provide, at least, minimal yards. <br /> 2. Septic field and tank prevent building closer to residence. <br /> CONCLUSION: <br /> a. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #770. Motion by Schwahn, second by Krushcke to deny. <br /> FINDING OF FACT: <br /> 1. Construction was accomplished without application for zoning <br /> permit. Applicant stated he just got carried away in the construc- <br /> tion of his pool for which a permit had been obtained. <br /> 2. There is adequate area around the pool in which to construct a <br /> deck without requiring a variance. <br /> CONCLUSION: <br /> a. Unnecessary hardship not proven. Motion carried. <br /> #771. Motion by Kruschke second by Purcell to grant a variance of 11 <br /> feet from required setback from USH 51 and 9 feet from required right <br /> side yard. <br /> FINDING OF FACT: <br /> 1. Existing garage is too close to highway and lot line. <br /> 2. Addition will be on the side away from the highway and no closer <br /> to side lot line than the existing building. <br />
