Appeal by Roessler and Sons Construction Company for a Special <br /> Exception Permit as provided by Section 10.16 (7) (g) Dane County <br /> Zoning Ordinance to grade and fill within 300 feet of Black Earth <br /> Creek on Lot #1, C.S.M. 2714 located in the SW 1/4 NE 1/4 Section 3, <br /> Town of Cross•Plains. <br /> IN FAVOR: Chuck Roessler OPPOSED: None TOWN BOARD: Not present <br /> No communication. <br /> #764. Appeal by Mr. & Mrs. John Payne for a variance from required <br /> setback from road and from required rear yard as provided by Section <br /> 10.17 (5) and 10.06 (8) (a) - Dane County Zoning Ordinance. Variances <br /> are necessary to permit existing location of a residence on Lot #1, <br /> Block #23, First Addition to Village of Morrisonville, 4609 Willow <br /> Street, Section 6, Town of Windsor. <br /> IN FAVOR: Tom Young, Realtor, representing J. Payne. OPPOSED: None <br /> TOWN BOARD: Letter, in favor. <br /> #765. Appeal by Larry R. Murphy for variance from required lot area, <br /> lot width and side yard as provided by Section 10.071 (4) (c) and <br /> 10.071 (7) (a) Dane County Zoning Ordinance. Variances are requested <br /> to permit construction of two duplex buildings providing individually <br /> owned units in part of the SE 1/4 SE 1/4 - Section 30, Town of Windsor. <br /> I Ce IN FAVOR: Larry Murphy. OPPOSED: None TOWN BOARD: Letter in <br /> opposition. <br /> #766. Appeal by Morey Airplane Company for a variance from flood zone <br /> fill requirements as provided by Section 10. 53 (d) (3) - Dane County <br /> Zoning Ordinance. Variance is requested to permit construction of an <br /> airplane hanger at 8300 Airport Road in the SW 1/4 NE 1/4 - Section 3, <br /> Town of Middleton. <br /> IN FAVOR: Jim Pohlman, Douthitt Association, Inc. , representing Morey <br /> Airplane Company OPPOSED: None TOWN BOARD: Not present - no <br /> communications. <br /> Dane County Highway Department by letter, expressed no objection to any <br /> of the appeals. <br /> The public hearing was closed. <br /> #758. Motion by Schwahn, regretfully, to deny, second by Purcell. <br /> FINDING OF FACT <br /> 1. Mr. Mack testified that there was ample room to locate the buildin• <br /> as required by ordinance but by inadvertant error one end of the <br /> building was set too close to the road. <br /> CONCLUSION: <br /> a. Unnecessary hardship not proven. Dahlk voting, no Krushchke, <br /> abstain. Motion carried - 3 to 1. <br />
