Existing house is already <br /> closer to the lake than those on adjacent lots and granting of <br /> variance would permit others to build as close to the lake. <br /> 5. Applicants property already has a large, existing deck on the <br /> shoreline. <br /> CONCLUSION: <br /> For Garage: a. Proven case of unnecessary hardship. b. Variance <br /> preserves the zoning ordinance as much as possible without injustice <br /> to applicant. c. Variance is necessary to provide right enjoyed <br /> by others. d. Variance is not contrary to rights of others or to <br /> the public interest. <br /> Motion carried. <br /> #739. Motion by Schwahn second by Kruschke to grant a variance of 11. 25 <br /> feet from required lot width on each lot. <br /> FINDING OF FACT: <br /> 1. All of the lots located in the Waubesa Beach Plat to the East <br /> and most of the lots in Assessor's Plat #1 to the North, East <br /> and South are smaller in width and area than the proposed lots. <br /> 2. Requiring this parcel to maintain above average lot width would <br /> not protect the shoreland area, the harm has already been done <br /> in this area. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #740. Motion by Schwahn second by Voges to hold in abeyance pending <br /> further information. Motion carried. <br /> #741. Motion by Voges second by Schwahn to grant a variance of 15 feet <br /> from required setback from right-of-way of CTH "BB" . <br /> FINDING OF FACT: <br /> 1. Extra right-of-way was purchased and widened towards Mr. Georgesor 's <br /> property. <br /> 2. Building existed before right-of-way was widened. <br /> 3. Proposed addition, except for door, will not be closer to the <br /> road than the existing building. <br /> 4. Water drainage and upward slope of property to the rear prevent <br /> addition from being located farther back. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br />
