BOARD OF ADJUSTMENT - Minutes
November 30,1978
Page 5
4:; 2. Other garages and some residences in this area are located as
close or closer to the road.
3. Construction of garage and driveway would permit autos to be
parked off of the road shoulder.
4. Variance from shoreland setback would in effect, permit less
setback from lake in this area. Existing house is already
closer to the lake than those on adjacent lots and granting of
variance would permit others to build as close to the lake.
5. Applicants property already has a large, existing deck on the
shoreline.
CONCLUSION:
For Garage: a. Proven case of unnecessary hardship. b. Variance
preserves the zoning ordinance as much as possible without injustice
to applicant. c. Variance is necessary to provide right enjoyed
by others. d. Variance is not contrary to rights of others or to
the public interest.
Motion carried.
#739. Motion by Schwahn second by Kruschke to grant a variance of 11. 25
feet from required lot width on each lot.
FINDING OF FACT:
1. All of the lots located in the Waubesa Beach Plat to the East
and most of the lots in Assessor's Plat #1 to the North, East
and South are smaller in width and area than the proposed lots.
2. Requiring this parcel to maintain above average lot width would
not protect the shoreland area, the harm has already been done
in this area.
CONCLUSION:
a. Proven case of unnecessary hardship.
b. Variance is necessary to provide right enjoyed by others.
c. Variance is not contrary to rights of others or to the public
interest.
Motion carried.
#740. Motion by Schwahn second by Voges to hold in abeyance pending
further information. Motion carried.
#741. Motion by Voges second by Schwahn to grant a variance of 15 feet
from required setback from right-of-way of CTH "BB" .
FINDING OF FACT:
1. Extra right-of-way was purchased and widened towards Mr. Georgesor 's
property.
2. Building existed before right-of-way was widened.
3. Proposed addition, except for door, will not be closer to the
road than the existing building.
4. Water drainage and upward slope of property to the rear prevent
addition from being located farther back.
CONCLUSION:
a. Proven case of unnecessary hardship.
b. Variance preserves the zoning ordinance as much as possible
without injustice to applicant.
c. Variance is not contrary to rights of others or to the public
interest.
Motion carried.
