Variance is necessary to permit construction of a <br /> residence on Lot #141 - Second Addition to Wildwood, Town of Fitchburg. <br /> IN FAVOR: W. McKee, Mr. Boschulte, presented petition from six neigh- <br /> bors; Steve Tadevich; Tom Welch. OPPOSED: None TOWN BOARD: Not <br /> present - letter Town Planning Commission in favor. <br /> #613. Appeal by Mrs. Virgil Ruhland for a variance from maximum height <br /> restriction as provided by Section 10.12 (3) (a) Dane County Zonink <br /> Ordinance. Variance is necessary to permit construction of a residen- <br /> tial garage in the SW 1/4 NW 1/4 of Section 22, Town of Black Earth. <br /> IN FAVOR: V. Ruhland OPPOSED: None TOWN BOARD: Not present. <br /> #614. Appeal by Charles Kneip for a variance from required setback <br /> from Yahara River as provided by Section 10.16 (7) (d) Dane County <br /> Zoning Ordinance. Variance is necessary to permit an addition to a <br /> residence located in the SE 1/4 SE 1/4 Section 14, Town of Dunn. <br /> IN FAVOR: C. Kneip OPPOSED: None TOWN BOARD: Not present. <br /> Letter - Milo Edwards, neighbor, no objection. <br /> #615. Appeal by John J. Wells for a variance from required setback <br /> from Vinburn Road as provided by Section 10.17 (3) Dane County Zoning <br /> Ordinance. Variance is necessary to permit an addition to a residence <br /> C; located in the NW 1/4 NW 1/4 Section 21, Town of Windsor. <br /> Letter from Robert F. Crary representing John Wells - requesting waiver <br /> of appearance. Motion by Voges second by Dahlk to grant waiver; <br /> motion carried. OPPOSED: None TOWN BOARD: Letter opposed. <br /> The public hearing was closed. <br /> #597. Motion by Voges, second by Dahlk to deny as per finding of fact. <br /> 1. Field inspection by Board disclosed other area, south of house <br /> where the building could be placed in compliance with ordinance and <br /> providing good access to driveway. <br /> CONCLUSION: No hardship other than self-created. Motion carried. <br /> #607. Motion by Dahlk second by Voges to grant a variance of 5 feet <br /> from required setback from centerline of North preenway Road as per <br /> finding of fact: <br /> 1. Existing residence is too close to road; approximately 100 <br /> years old. <br /> . 2. Addition is on rear of house - will not make it more non-conformin, . <br /> 3. Proposed addition will enlarge living area - is not feasible in <br /> other location. • <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public. <br /> Cor <br /> interest. <br /> Motion carried. <br />
