1 <br /> MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> MEETING OF SEPTEMBER 7, 1977 <br /> PRESENT: Erickson, Dahlk, Voges <br /> ALSO PRESENT: Fleck. . <br /> i <br /> The Board met at 1:30 P.M. in Room #314, City-County Building to act on <br /> appeal #590; Robert Aberg, Town of Dunn, held in abeyance from the <br /> public hearing of August 19, 1977. <br /> The meeting was called to order by Chairman Erickson and the finding of <br /> fact was read: 2 <br /> 1. Board of Adjustment q <br /> Adjustment jurisdiction extends 300 feet North and South i <br /> of Swan Creek. 3 <br /> 2. Natural swale on West side of Aberg property and South of Swan Creek <br /> already contains and controls surface water between Lalor Road and the <br /> Aberg Property. This water is diverted North to Swan Creek on the up- <br /> stream side of proposed road. Therefore, proposed road fill will not <br /> affect this drainage or be affected by it. <br /> 3. Terrain North of Swan Creek slopes upward from elevation of 850' , <br /> minus, (USGS) to above 900' and runs parallel (more or less) to Swan <br /> Creek. Surface drainage is Southward or at 90° ± angle to Swan Creek. <br /> Proposed road is also at 90° angle with creek and therefore will not <br /> obstruct surface flow nor be unduly affected by the surface flow. <br /> 4. Diking affect of proposed road and susceptibility to washing (sedi- <br /> mendation) will be minimal because of the existing natural swale men- ii <br /> tioned in 2. above and the normal flow of surface water from the North <br /> flowing South to the creek in the same (more or less) direction as the <br /> proposed road. There would not be a necessity for any surface water <br /> Ir; from the North to cross the proposed road. i <br /> 5. Drainage to the East of proposed road will not be affected. <br /> 6. The scientific area located at the Southeast corner of the Aberg <br /> property is protected by high ground between the proposed road and <br /> the scientific area. Surface flow from proposed road area will not <br /> reach the scientific area. <br /> 7. Water table should not be affected because of minimal affect of <br /> proposed road on drainage pattern of area. The existing berm ex- <br /> plained by Mr. Calvin DeWitt at the public hearing as causing a drop in <br /> water table, lays parallel to the creek and therefore across the normal <br /> drainage flow. The proposed road would not have this affect. See #2, <br /> 3 and 4 above. ii <br /> 8. Opening or culvert in stream bed will be approximately two times <br /> the size of the existing culvert under Lalor Road. Bridges, culverts, <br /> etc. , placed in stream bed are subject to Department of Natural Re- <br /> sources approval and specifications and do not require Dane County i <br /> Board of Adjustment approval. <br /> o <br /> 9. Development of area is not the question before the Board. Develop- <br /> ment of area is under jurisdiction of the Dane County Subdivision and k <br /> Zoning Ordinances. <br /> g <br /> 6 <br /> Motion by Voges second by Dahlk to grant the Special Exception, as pro- <br /> posed, with the conclusion that the proposed fill for road will not ad- <br /> versely affect erosion, sedimentation, or safe and healthful conditions. !' <br /> Motion carried unanimously.
