MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT. MAY 20, 1977 PRESENT: Erickson, Dahlk, Votes ALSO PRESENT: Enger, Fleck. Meeting was called to order by Chairman Erickson at 7:30 P.M. in room #226. Motion by Dahlk second by Voges to approve the minutes of May 15, 1977 and May 17,1977. Motion carried. The notice was read and the public hearing was opened. 4568. Appeal by Russell Greve for a variance from required setback from the centerline of C.T.H. "JG" as provided by Section 10.17 (2) Dane County Zoning Ordinance. Variance is necessary to permit an additio to an existing building located in part of the SW 1/4 SE 1/4 Section 35, Town of Vermont. IN FAVOR: R. Greve OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present - Dane County Highway letter, no objection. #569. Appeal by Patrons Merchantile, Inc. for a variance from distance required between signs as provided by Section 10.41 (3) (a) and 10.42 (3) (a) Dane County Zoning Ordinance. Variance is necessary to permit a sign in part of the SW 1/4 SE 1/4 of Section 15, Town of Mazomanie. IN FAVOR: Ray Rettemund, Mgr. OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present. CIF #570. Appeal by Stanley Phillips for a variance from maximum accessory building height as provided by Section 10.12 (3) (a) Dane County Zoning Ordinance. Variance is necessary to permit a 16 foot high accessory building on property located in part of the NW 1/4 NW 1/4 of Section 23, Town of Vienna. IN FAVOR: S. Phillips OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present. #571. Appeal by Robert Stauber, Architect, for a variance from required rear yard as provided by Section 10.05 (8) (a) Dane County Zoning Ordinance. Variance is necessary to permit construction of a residence on Lot #44, Cherry Wood, Section 30, Town of Middleton. IN FAVOR: R. Stauber OTHERS IN FAVOR: None OPPOSED: None TOWN BOARD: Not present. The public hearing was closed. • #568. Motion by Voges second by Dahlk to grant a variance of 31 feet from required setback from the center of CTH JG as per finding of fact: 1. Proposed addition will be located behind the front line of the building. 2. Line of vision on JG will not be impaired by addition. 3. No objection from Dane County Highway. CONCLUSION: a. Variance preserves the zoning ordinance as much as possible without injustice to applicant. b. Variance is not contrary to rights of others or to the public interest. Motion carried.
