Motion by Voges second by Dahlk to grant a 4 foot variance from
maximum height requirement as per finding of fact .
1. Zoning ordinance permits an accessory building to be as large as
the residence on the premises.. The 12 foot minimum height restriction
creates a problem with the conventional 4/12 pitch roof on this size
building even a 2/12 pitch roof would require a one foot variance and
cause structural problems because of snow and ice.
2. Property is located in a generally open agricultural area.
CONCLUSION:
a. Proven case of unnecessary hardship.
b. Variance preserves the zoning ordinance as much as possible
1 IF: without injustice to applicant.
c. Variance is not contrary to rights of others or of the public
interest.
Motion carried.
1/571. Motion by Dahlk second by Voges to deny variance appeal as per
finding of fact.
1. Lot is large enough with no topographic problems, to build a resi-
dence which would comply with the requirements of the Zoning Ordinance,
CONCLUSION:
a. No hardship proven.
Motion carried.
11474 . Motion by Voges second by Dahlk to deny variance appeal as per
finding of fact.
RECAP: There is an existing main residence on the property and a
cottage which is located above the boathouse on the lake side of the
property. The purpose and intent of variance was to permit renovation
of cottage over the boathouse so that it cooid be rented out and pro-
' vided some income off the property while waiting for the public sewer
for the main residence. Contention was that residential use of boat-
house cottage was commenced before the adoption of the ordinance and
could continue as a non-conforming use.
w, 1. Zoning ordinance permits only one residence on one parcel of land.
