MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT FEBRUARY 18, 1977 41:00 Present: Erickson, Dahlk, Voges Also present: Enger, Fleck. The meeting was called to order at 7:30 P.M. by Chairman Millard ; Erickson in Room #226, Ci`y-County Building, to hold a public hearing as published by Class II notice. Motion by Voges, second by Dahlk to approve the minutes of June 21, and February 15, 1977. Motion carried. The notice was read and the public hearing was opened. #550. Appeal by Sandra L. Miller for a variance from area requirement of 5 acres net as provided by Section 10.12 (4) (a) Dane County Zoning Ordinance. Variance is necessary to permit the keeping of livestock on 4. 3 acres located in part of the SW 1/4 NE 1/4 of Section 31, Town of Springfield. IN FAVOR: Sandra Miller - OTHERS IN FAVOR: None - OPPOSED: None TOWN BOARD: Not present. #551. Appeal by Phyllis Lovrien for a variance from required setback as provided by Section 10.17 (2) Dane County Zoning Ordinance. Variance is necessary to permit a garage and loft addition to a residence located on Lot #8, Block #1, Colladay Park, Town of Dunn. IN FAVOR: Phyllis Lovrien - OTHERS IN FAVOR: None - OPPOSED: None TOWN BOARD: Not present - COMMUNICATION: Dane County Highway. #552. Appeal by Draper and Kramer, Inc. of Wisconsin for a variance from required distance from an intersection as provided by Section 10.42 (2) (b) Dane County Zoning Ordinance. Variance is necessary to permit a sign at the intersection of C.T.H. "D" (Fish Hatchery Road) • and Traceway Drive, Section 3, Town of Fitchburg. The public hearing was closed. #550. Motion by Voges, second by Dahlk to hold in abeyance pending effort to amend the Zoning Ordinance as per finding of fct: 1. The variance requested is a problem common to many property owners within Dane County and the appropriate remedy would be a change in the Zoning Ordinance. Motion carried. #551. Motion by Voges, second by Dahlk to grant a variance of 27 feet from the required setback from the centerline of CTH "AB" as per finding of fact. 1. Location, other than as proposed, would require substantial filling, retaining walls, removal of trees, etc. 2. Most of the garages on this side of CTH "AB" are close to the road because of the steep slope down to the lake. 3. Dane County Highway expressed no objection if reasonable hardship were involved. A. Proven case of unnecessary hardship. B. Variance is necessary to provide right enjoyed by others. ' C. Variance is not contrary to rights of others or to the public interest. Motion carried.
