MINUTES OF THE DANE COUNTY BOARD OF ADJUSTMENT <br /> FEBRUARY 18, 1977 <br /> 41:00 Present: Erickson, Dahlk, Voges <br /> Also present: Enger, Fleck. <br /> The meeting was called to order at 7:30 P.M. by Chairman Millard <br /> ; Erickson in Room #226, Ci`y-County Building, to hold a public hearing <br /> as published by Class II notice. Motion by Voges, second by Dahlk <br /> to approve the minutes of June 21, and February 15, 1977. Motion <br /> carried. The notice was read and the public hearing was opened. <br /> #550. Appeal by Sandra L. Miller for a variance from area requirement <br /> of 5 acres net as provided by Section 10.12 (4) (a) Dane County Zoning <br /> Ordinance. Variance is necessary to permit the keeping of livestock <br /> on 4. 3 acres located in part of the SW 1/4 NE 1/4 of Section 31, Town <br /> of Springfield. <br /> IN FAVOR: Sandra Miller - OTHERS IN FAVOR: None - OPPOSED: None <br /> TOWN BOARD: Not present. <br /> #551. Appeal by Phyllis Lovrien for a variance from required setback <br /> as provided by Section 10.17 (2) Dane County Zoning Ordinance. Variance <br /> is necessary to permit a garage and loft addition to a residence located <br /> on Lot #8, Block #1, Colladay Park, Town of Dunn. <br /> IN FAVOR: Phyllis Lovrien - OTHERS IN FAVOR: None - OPPOSED: None <br /> TOWN BOARD: Not present - COMMUNICATION: Dane County Highway. <br /> #552. Appeal by Draper and Kramer, Inc. of Wisconsin for a variance <br /> from required distance from an intersection as provided by Section <br /> 10.42 (2) (b) Dane County Zoning Ordinance. Variance is necessary to <br /> permit a sign at the intersection of C.T.H. "D" (Fish Hatchery Road) <br /> • and Traceway Drive, Section 3, Town of Fitchburg. <br /> The public hearing was closed. <br /> #550. Motion by Voges, second by Dahlk to hold in abeyance pending <br /> effort to amend the Zoning Ordinance as per finding of fct: <br /> 1. The variance requested is a problem common to many property <br /> owners within Dane County and the appropriate remedy would be <br /> a change in the Zoning Ordinance. Motion carried. <br /> #551. Motion by Voges, second by Dahlk to grant a variance of 27 feet <br /> from the required setback from the centerline of CTH "AB" as per <br /> finding of fact. <br /> 1. Location, other than as proposed, would require substantial <br /> filling, retaining walls, removal of trees, etc. <br /> 2. Most of the garages on this side of CTH "AB" are close to the <br /> road because of the steep slope down to the lake. <br /> 3. Dane County Highway expressed no objection if reasonable hardship <br /> were involved. <br /> A. Proven case of unnecessary hardship. <br /> B. Variance is necessary to provide right enjoyed by others. <br /> ' C. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br />
