Gerstner <br /> OPPOSED: None <br /> COMMUNICATION: Town Board in favor. <br /> TOWN BOARD: In favor. <br /> The public hearing was closed. <br /> #1321. Miller/Schwahn grant a variance of 12 feet, more or less from the <br /> required setback from CTH BB, subject to the condition that the entryway <br /> shall be removed at the owners expense if future road improvement requires <br /> additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Existing residence, built in latter 1800's, is nonconforming as to <br /> setback. <br /> 2) . Basement portion of residence is entirely within the required set- <br /> back and therefore a complying location for the basement entry is not <br /> possible. <br /> 3) . Entry will be constructed as far from road as is possible. Side of <br /> house is substantially closer to the road. <br /> CONChiIS TON: <br /> a) . Proven case of unnecessary hardship. <br /> h) . Vari anco is not contrary to right.; of others or to the public in- <br /> terest. <br /> c) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. 5-0. <br /> • <br /> #1322. Schwahn/Miller grant a variance of 6 feet more or less, from the <br /> required left side yard and a variance of 16 feet from the required set- <br /> back from the normal high water mark_ <br /> FINDING OF FACT: <br /> 1) . proposed addition is second story above existing residence; there <br /> will be no further encroachment into side yard or shoreland setback. <br /> 2) . Existing residence was constructed prior to ordinances, and is non- <br /> conforming as to sideyard and setback from water. The second story <br /> addition may not be permitted without a variance. <br /> .CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Variance is necessary to provide right enjoyed by others. <br /> c) . Hardship is caused by the oridnance and is not self-imposed. <br /> Motion carried. 5-0. <br /> #1323. Krushchke/Schwahn to grant avar.iance of 35 feet, more or less, <br /> from the required loft side yard for'-barn. <br /> FINDING OF FACT: <br /> 1) . Required side yard would encroach into the paddock area of adja- <br /> cent riding stable. <br /> 2) . Ordinance intent of barn separation from adjacent property is <br /> rendered mcaninglc , , because adjacuut riding stable also accommodates <br /> livestock and in greater numbers than the barn in question. <br /> CONCLUSION_ <br /> a) .
