Hibbard OPPOSED: None COMMUNICATION: Town Board and Plan <br /> Commission, no objection <br /> #1270. Appeal by Jeff Klehfoth for a variance from required sideyard and lot <br /> width as provided by Section 10.071 (4) (c) & (7) to permit conversion of <br /> single family residence to duplex at 4348 Jordan Drive in the SW 1/4 SE 1/4 - <br /> Section 8, Town of Dunn. <br /> IN FAVOR: J. Miller/Harvey to grant a variance of 0.1 feet from required setback <br /> from front property line. <br /> FINDING OF FACT: <br /> 1) . 0. 1 foot is 1 inch, more or less. Measurements of that close of a <br /> distance could vary either way depending upon equipment utilized, . <br /> etc. <br /> 2) . 0.1 foot encroachment would not cause any adverse effect. <br /> 3) . Compliance with required setback would require major structural altera <br /> tion. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public interes . <br /> Motion carried. <br /> #1265. Miller/Harvey to grant a variance of 3 feet, more or less, from requir d <br /> right side yard. <br /> FINDING OF FACT: <br /> 1) . Building will replace old nonconforming garage. <br /> 2) . Other residential and accessory buildings in this area are as close or <br /> closer to side lot lines. <br /> 3) . Garage placed farther back on lot would encroach into flood zone area. <br /> and soft ground due to high water table. . <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is necessary to provide right enjoyed by others. <br /> 3. Variance is not contrary to rights of others or to the public interes . <br /> 4) Motion carried. <br />
