Schwahn/ <br /> Harvey to extend the time of the variance for 1 year; granted. 5-0. <br /> #1238. Wetzel - Sun Prairie: Setback variance was granted contingent upon <br /> the town vacating 15 feet of the radius of the cul-de-sac thereby providing <br /> more than enough setback for the residences located on the cul-de-sac. The <br /> town board decided that the 75 foot radius cul-de-sac was needed for school <br /> bus turning and denied the request to vacate. A setback variance without <br /> contingency is still required. Schwahn/Harvey to grant a variance off 4 <br /> feet, more or less, from required setback from Marick Court. <br /> FINDING OF FACT: <br /> 1) . 75 foot radius for cul-de-sac is oversized; County Subdivision <br /> Ordinance requires only 60 foot radius. <br /> 2) . This residence and two others existing on the court were located <br /> in compliance with the County required 60 foot radius. <br /> 3) . Inspection of the Wetzel construction disclosed the overall problem. <br /> CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Variance preserves the Zoning Ordinance as much as possible without <br /> 41, injustice to applicant. <br /> c) . Variance is not contrary to rights of others or to the public in- <br /> terest. <br /> d) . Hardship is caused by Town Ordinance. Motion carried. 5-0. <br /> #1230. Stehr - Westport: Request by contractor to forego seeding, mulchin; <br /> and mat requirements. Ground is frozen and erosion protection is not neces <br /> sary until spring. Dormant seeding/matting after freeze could yield ques- <br /> tionable results. Town engineer suggested use of staked in-place straw bal- <br /> siltation filter at lake end of the project. <br /> Schwahn/Harvey to waive the requirement of immediate dormant seeding, mulch <br /> and matting at this time, but, said dormant seeding and 7 straw depth <br /> mulching shall be done as early in 1985 as is possible to provide an esta- <br /> blished growth in spring; motion carried. 5-0. <br /> Kruschke/Miller adjourned.
