Required fill would violate rights ofothers and be contrary to publi. interest. Motion carried. 1252. Special Exception Permit: Kruschke/Schwahn to grant the permit as proposed: • FINDING OF FACT: 1) . Fill is required on the left side of the lot to comply with flood zone regulations to permit construction of a residence. 2) . A minimal amount, 1 - 1 1/2 depth, of fill is necessary to meet flood zone regulations. (1010 3) . Proposed fill will not cause surface water run-off problems for the ad- jacent properties. CONCLUSION: 1) . The project as planned will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. #1253. Schwahn/Kruschke to grant the following variances for the proposed lots: Lot #1: 24 feet from required lot width. Lot #2: 30 feet from required lot width. Lot #2: 18 feet from required building setback from St. Cyr Road. FINDING OF FACT: 1) . Existing lots in the area are as small or smaller than those propose' . 2) . Abrupt reduction in road width at SE corner of lot creates setback problem. CONCLUSION: 1) . Proven case of unnecessary hardship. 2) . Variance is necessary to provide right enjoyed by others. 3) . Variance is not contrary to rights of others or to the public in- terest. Motion carried. #1254. Harvey/Kruschke to grant a variance of 7 feet, more or less, from required left side yard: FINDING OF FACT: 1) . Other residences in the area are as close or closer to lot lines.
