A variance as requested, would set a precedence which others could utilize <br /> as a basis for future variances. <br /> 6. A variance may he granted only for unnecessary hardship (caused by <br /> the ordinance or conditions on the land) and may not be granted for <br /> conditions or reasons personal to the applicant. <br /> CONCI1W IUN: <br /> 1) . Unnecessary hardship was not proven. <br /> 2) . All desired functions could be provided within the requirements of <br /> the ordinance and without a rear yard variance. <br /> 3) . Denial of variance does not prohibit the applicant from construc- <br /> ting a duplex unit. <br /> Motion carried. <br /> #1202. Held in abeyance: Younger - Roxbury <br /> Krushchke/Harvey to grant the spdcial exception permit to fill an area no <br /> larger than 100 feet in width, to a maximum depth of 2 feet and located <br /> as per the site plan submitted. <br /> CONDITION: <br /> 1. Fill shall be contoured into existing grade. <br /> 2. Variance is not contrary to rights of others or to the public interest. <br /> 3. Hardship is caused by theordinance and is not self-imposed. <br /> FINDING OF FACT: <br /> Fill will be utilized for construction of an emergency shelter and <br /> recreational building for the campground and constitutes a reasonable <br /> and needed use. <br /> • CONCLUSION: <br /> 1) .
