Schwahn/Purcell grant a variance of 4 feet, more or less from re- <br /> quired-left-side yard. <br /> FINDING OF 'FACT: <br /> 1. Existing building is non-conforming as to side yard. Building was <br /> constructed when 0 foot side yard was allowed. <br /> 2. Ordinance change in 1976 made building non-conforming. <br /> 3. Addition will be in-line with existing building, jog in building to <br /> meet required side yard would cause loss of space for no practical <br /> purpose. <br /> CONCLUSION: <br /> 1}. Proven case of unnecessary hardship. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 3) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1170. Lot area variance-request for reconsideration Roet.tiger, Section 27, <br /> Town of Madison. <br /> Zoning Committee has granted a variance from the subdivision ordinance. Othe• <br /> lots in the area are as small as the proposed change will create. <br /> Purcell/ Kruschke to grant a variance of 8,930 square feet from minimum .required <br /> lot area. This will allow the relocation of the rear, common, stake 14 feet <br /> to the right (NWly) and enlarge Lot #2. The front common stake will remain <br /> as is. .. <br /> FINDING OF FACT: <br /> 1. Proposed change would have been allowed prior to Shoreland Ordinance <br /> adopted in 1970 which caused most of the lots in the area to be non- <br /> conforming. <br /> • <br /> 2. Other lots in area are as small as the proposed change would create. <br /> 3. Lot #1 after the land transfer would be a buildable lot not requiring <br /> locational variance for a residence. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #1168. Bolliger - Springdale - Request was again reviewed.
