Board of Adjustment - Minutes <br /> September 22, 1983 <br /> Page 5 <br /> ( FINDING OF FACT: <br /> 1. Birch trail is proposed to be relocated farther to the East. Mater <br /> along the existing road must be removed to provide new roadbed but <br /> variance is necessary to do so. <br /> 2. 9 Month review will monitor the project to assure safety, etc. fact <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is not contrary to rights of others or to the public is <br /> terest. <br /> Motion carried. <br /> #1190. Motion by Kruschke, second by Purcell to grant a variance of 15 fe. <br /> more or less, from the required setback from Union Road. <br /> FINDING OF FACT: <br /> 1. Existing resdience is non-conforming as to setback. <br /> 2. Addition/alteration will be farther from road than existing building <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is not contrary to rights of others or to the public in <br /> terest. <br /> Motion carried. <br /> #1191. Motion by Harvey second bySchwahn to grant a variance of 4 feet, <br /> more or less, from the required setback from Thurber Avenue. <br /> (110 FINDING OF FACT: <br /> 1. Existing lot is too shallow for a conventional garage to be located <br /> in compliance. <br /> 2. Several similar variances have been granted in the area. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #1192. Motion by Purcell, second by Kruschke to grant a variance of 7.5 f <br /> from required left side yard. <br /> FINDING OF FACT: <br /> 1. Area to left of lot is cropland not likely to be developed. <br /> 2. Slope to rear of residence prevents addition to residence without e: <br /> cessive filling. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance preserves the zoning ordinance as much as possible wit <br /> injustice to applicant. <br /> Motion carried. <br /> #1193. Motion by Schwahn second by Harvey to grant the special exception <br /> permit as proposed with the following conditions: <br /> 1. The filled and/or graded and disturbed areas shall be sodded or seeded <br /> fast growing grasses and mulched to prevent siltation or erosion. <br /> L00 2. The applicant shall request inspection by the Dane County Zoning Depar <br /> upon completion of the project. <br /> FINDING OF FACT: <br /> 1.
