Motion by Kruschke, second by Purcell to grant a variance of 30 fee- <br /> more or less, from required setback from normal high waterline. <br /> FINDING OF FACT: <br /> - 1. Existing residence is non-conforming as to setback from water. <br /> 2. Fire damage is less than 50% and building is structurally sound. <br /> 3. Renovation/alteration will be approximately 60 feet from waterline <br /> but cannot be done without variance. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Motion by Purcell, second by Schwahn to grant a variance of 7 feet, <br /> more or less, from the required setback from U.S.H. 151, Park Street, with <br /> the condition that the addition shall be removed at the owners expense if <br /> future road improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> (IF 1. Addition to side or rear of building is not practical because of str <br /> tural and lay-out design. <br /> 2. This area is intermixed between properties which are located in the <br /> City of Madison and those located in the town. Properties located i <br /> the City have a less restrictive setback and several buildings are <br /> located much closer to the road than the proposed addition. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance preserves the zoning ordinance as much as possible with <br /> injustice to applicant. <br /> 3) . Variance is necessary to provide right enjoyed by others. <br /> 4) .
