Motion by Kruschke, second by Schwahn to grant a variance of <br /> 46 feet, more or less, from the required setback from USH 51 with the <br /> condition that the canopy shall be removed at the owners expense if future <br /> road improvement requires additional right-of-way. <br /> • FINDING OF FACT: <br /> 1) . Gas pumps are allowed, by ordinance, to be 12 feet from right-of-wa <br /> canopy to be effective must be over gas pumps. <br /> 2) . USH 51 is in the process of being re-located and existing highway <br /> will become a town road. <br /> 3) . Canopy will not be a traffic hazard. <br /> 4) . Similar variances have been granted to others. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> 3) . Variance is not contrary to rights of others or to the public <br /> 41101 interest. <br /> Motion carried. <br />
