BOARD OF ADJUSTMENT - Minutes <br /> July 22, 1982 <br /> Page 4 <br /> Lig 2) . Addition on right side will be only slightly closer to the property. <br /> line- and left side addition is for a solar heating area. Location <br /> elsewhere is prevented by orientation of the existing buildings. <br /> Reduced area to provide side yard compliance would result in loss <br /> of efficiency for the solar system. <br /> 3) . Blockage of access to lake side of residence is no concern as stated <br /> by Mr. Wheeler; septic will be replaced by holding tanks located in <br /> front and garage can be provided with another large door on the lake- <br /> side <br /> 4) . Other residences in the area encroach as far or farther into required <br /> -yards and setback. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship_ <br /> 2) . Variance is necessary to provide right enjoyed by others. <br /> Motion carried. <br /> #1089. Motion by Harvey, second by Purcell to grant a variance of .15 feet, <br /> more or less from required setback from right-of-way, with the condition that <br /> the garage shall be removed at the owners expense if future road improvement <br /> requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Complying location of the addition is prevented by location of septic <br /> -mound system, sewer lines and the large willow tree. <br /> CONCLUSION: <br /> Proven case of unnecessary hardship. <br /> Motion carried: <br /> #1079. C. Swacina - Lot #47 and E 1/2 #48, Brickson Park - Dunn held in <br /> abeyance. Revised location submitted. Motion by Purcell, second by Harvey <br /> to grant a variance of 28, more or less, feet from the required setback <br /> from Jordan Drive with the condition that the garage shall be removed at the <br /> owners expense- if future road improvement requires additional right-of-way. <br /> FINDING OF: FACT: <br /> 1) . Angle of right-of-way across the property and large tree prevent <br /> complying location. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #876. Control Tower Truck Stop Section 4, Burke. <br /> Board of Adjustment inspection discloses that conditions of the Special <br /> Exception Permit have not been complied with. Specifically - 1) . Required <br /> shrubs, etc. , have not been planted and 2) . at least two areas of the buffer <br /> strip and slope have been eroded: Motion by Purcell, second by Harvey to <br /> direct the Zoning Department to take appropriate enforcement action. <br /> Motion carried. <br /> #1075. J. Starry - Paoli, Section 3, Town of Montrose. <br /> Zoning inspection has disclosed that setback distances submitted were in <br /> error. Amendment to variance is necessary to -permit construction as it exists. <br /> All other factors of variance remain the same. Motion by Harvey, second by <br /> AMA . : <br />
