Connors OPPOSED: none COMMUNICATION: none <br /> #1081. Appeal by John Sveum/ Yahara Builders for a variance from required <br /> setback from front property line as provided by Sec. 1017 (4) to permit <br /> existing location of a residential garage at 3008 Shadyside Drive, Lot 2 <br /> Atkinson's Addition to Crystal Springs, Section 30 Town of Pleasant Springs <br /> IN FAVOR: J. Sveum OPPOSED: none COMMUNICATION: none <br /> #1082. Appeal by Paul Francois for a Special Exception Permit to construct <br /> ponds within 300 feet of a tributary of the Sugar River as provided by Sec. <br /> 11.05 (g) . Ponds will be located in the N 1/2 Section 27 Town of Montrose. <br /> IN FAVOR: P. Francois OPPOSED: none COMMUNICATION: none <br /> #1083. Appeal by Stauffer and Sons, Inc. for a variance from required set- <br /> back from road as provided by Sec. 1017 (2) to permit existing location of <br /> new addition to building at 2819 C.T.H. "F" , NW 1/4 SE 1/4 Section 7 Town <br /> of Blue Mounds. <br /> NO APPEARANCES; Mr. Stauffer had called the Zoning Department and informed <br /> them that he wished to withdraw the appeal, the State Highway Department <br /> has agreed to realign the right-of-way to provide the required setback for <br /> the building. <br /> The public hearing was closed. <br /> Lir #1075. Motion by Purcell 2'nd by Harvey to grant a variance of 3.2 feet, <br /> more or less, from the required setback from Canal St. and 3.0 feet , more <br /> or less, from the required setback form Range Trail. <br /> FINDING OF FACT: <br /> 1. Construction will replace old deteriorated porch which was removed and <br /> will not encroach into the setback areas any further than the old porch. <br /> 2. Existing residence is nonconforming as to setback, any porch or entry on <br /> the front would require a variance. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship <br /> 2. Variance is not contrary to rights of others or to the public interest <br /> 3. Hardship is caused by the ordinance and is not self imposed <br /> Motion carried. <br /> #1076. Motion by Harvey 2'nd by Purcell to grant the Special Exception Per- <br /> mit as proposed with the following conditions:1. The filled and/or graded <br /> and disturbed areas shall be sodded or seeded with fast growing grasses <br /> and mulched to prevent siltation or erosion. 2. The applicant shall request <br /> inspection by the Dane County Zoning Dept. upon completion of the project. <br /> FINDING OF FACT <br /> 1. Project will protect shoreline and improve property <br /> 2. Proposed grade and the minimal amount of fill will not cause siltation, <br /> erosion, etc. , if area is sodded or seeded. <br /> CONCLUSION <br /> 1. The project as planned with the specified conditions will not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful conditions. <br /> Motion carried. <br /> #1077. Motion by Purcell 2'nd by Harvey to grant the Special Exception Per- <br /> mit as proposed with the following conditions: 1.The filled and/or graded <br />
