The project as planned, with specified conditions; will not result in substantial detriment to navigable waters by ero- sion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. #1073. Motion by Harvey, second by Kruschke to hold in abeyance to .allow time for Benjamin Plumbing to contact other businesses in the area to determine the feasibility of providing one sign to advertise all businesses or to effectively indentify the area. Motion carried. #1074. Motion by Purcell, second by Schwahn to grant a 42 foot varianc= from the required setback from C.T.H. "K" with the following condition: The barn addition shall be removed at the owners expense if future road improvement requires additional right-of-way. FINDING OF FACT: 1) . Highway improvements have caused the barn to be non-conforming as to setback. 2) . The addition will not be closer to the road than. the existing barn. 3) . The addition will not cause a traffic hazard. CONCLUSION: 1) . Proven case of unnecessary hardship. 2) . Variance is notcontrary to rights of others or to the public interest. 3) . Hardship is caused by the ordinance and is not self-imposed. Motion carried. The Board discussed methods to resolve or prevent situations such as #1065, Bates-Meyer. Motion by Kruschke, second by Schwahn to request that the Zoning Committee take under consideration the Board of Adjust- ment suggestion that a location survey be required for, at least, the construction of new buildings. #1002. Allen Harvey presented a request from County Executive Jonathan Barry to re-review the variance appeal of Ken Laufenberg regarding his building located in Section 1, Town of Blue Mounds at 3137 S.T.H. 78. The consesus of opinion of the Board was that they could not change their decision. A court order is in effect and as far as they were concerned the matter is closed. Harvey presented a response to Executi - Barry which was approved by the Board. Motion by Schwahn, second by Kruschke to include in the letter a respectful request that the County Executive please contact the Zoning Administrator or Assistant Zoning Administrator in these matters; motion carried. Motion by Schwahn, second by Purcell to adjourn. Motion carried.
