The project as planned, with specified conditions; will not <br /> result in substantial detriment to navigable waters by ero- <br /> sion, sedimentation, impairment of fish or aquatic life, or <br /> safe and healthful conditions. <br /> #1073. Motion by Harvey, second by Kruschke to hold in abeyance to <br /> .allow time for Benjamin Plumbing to contact other businesses in the <br /> area to determine the feasibility of providing one sign to advertise <br /> all businesses or to effectively indentify the area. <br /> Motion carried. <br /> #1074. Motion by Purcell, second by Schwahn to grant a 42 foot varianc= <br /> from the required setback from C.T.H. "K" with the following condition: <br /> The barn addition shall be removed at the owners expense if future road <br /> improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . Highway improvements have caused the barn to be non-conforming <br /> as to setback. <br /> 2) . The addition will not be closer to the road than. the existing <br /> barn. <br /> 3) . The addition will not cause a traffic hazard. <br /> CONCLUSION: <br /> 1) . Proven case of unnecessary hardship. <br /> 2) . Variance is notcontrary to rights of others or to the public <br /> interest. <br /> 3) . Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> The Board discussed methods to resolve or prevent situations such as <br /> #1065, Bates-Meyer. Motion by Kruschke, second by Schwahn to request <br /> that the Zoning Committee take under consideration the Board of Adjust- <br /> ment suggestion that a location survey be required for, at least, the <br /> construction of new buildings. <br /> #1002. Allen Harvey presented a request from County Executive Jonathan <br /> Barry to re-review the variance appeal of Ken Laufenberg regarding his <br /> building located in Section 1, Town of Blue Mounds at 3137 S.T.H. 78. <br /> The consesus of opinion of the Board was that they could not change <br /> their decision. A court order is in effect and as far as they were <br /> concerned the matter is closed. Harvey presented a response to Executi - <br /> Barry which was approved by the Board. Motion by Schwahn, second by <br /> Kruschke to include in the letter a respectful request that the County <br /> Executive please contact the Zoning Administrator or Assistant Zoning <br /> Administrator in these matters; motion carried. <br /> Motion by Schwahn, second by Purcell to adjourn.
