Proposed building is farther from road than existing buildings. <br /> 2. Farm-yard complex is limited in buildable area because it is locat . <br /> on a knoll. <br /> 3. Location will preserve productive land. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #1028. Motion by Schwahn, second by Purcell to grant a variance of 0.95 <br /> foot from required setback from C.T.H. "C" . CONDITION: The pertinent <br /> portion of the building shall be removed at the owners expense if future <br /> road improvement requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1. Location of building was determined by stakes set by surveyor and <br /> was set farther back than required by Zoning Ordinance. First <br /> inspection by Zoning Department and utilizing existing surveyor <br /> stakes, showed location to be okay. <br /> 2. Subsequent survey based on County monumentation disclosed that <br /> centerline of C.T.H. "C" was farther east than originally shown <br /> thus causing setback encroachment by new residence. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship. <br /> 2. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> • #917. Oscar Mayer Company - variance from height restriction Truax Field. <br /> Motion by Kruschke, second by Purcell to extend deadline of expiration <br /> date to September 9, 1981. Motion carried. <br /> #1002. Ken Laufenberg - setback variance denied - Section 1 , Blue Mounds <br /> Court order as per stipulated agreement requires order from Board of <br /> Adjustment. Motion by Schwahn, second by Kruschke to order compliance <br /> as follows: <br /> 1) . The building shall be made to comply with required setback from <br /> S.T.H. 78 by removal of, at least, that portion of the building <br /> which encroaches into the setback area. <br /> 2) . The Zoning Department shall be notified when the building has <br /> been corrected so that setback compliance may be verified. <br /> 3) . If required setback distance cannot be accurately determined <br /> by the Zoning Department, a licensed surveyor shall be engaged <br /> to provide said verification. <br /> 4) . Compliance will be expected no later than November 1, 1981 . <br /> Motion carried. <br />
