"E" with the condition that: <br /> The addition shall be removed at the owners expense if future road improve- <br /> ment requires additional right-of-way. <br /> FINDING OF FACT: <br /> 1. Existing shed, which is closer to the road will be removed to facilitate <br /> proposed addition. <br /> 2. Farm yard complex is limited in area because of existing buildings <br /> with steep bank at the rear. <br /> 3. Setback encroachment will be improved by the removal of old shed. <br /> 4. Dane Countytlighway had no objection. <br /> CONCLUSION: <br /> 1. Proven case of unnecessary hardship_ <br /> 2. Variance is not contrary to rights of others or to the public in- <br /> terest. <br /> Motion carried. <br /> #986. Motion by Schwahn, second by Voges to grant the Special Exception <br /> Permit as proposed with the following conditions: <br /> 1. Permit granted as per plans submitted. <br /> 2. The filled, graded and disturbed areas shall be sodded or seeded with <br /> fast growing grasses and mulched to prevent siltation or erosion. <br /> 3. The project shall be approved by the town engineer and road crew <br /> foreman to alleviate potential drainage problems. <br /> 4. The applicant shall request inspection by the Dane County Zoning <br /> Department upon completion of the project. <br /> FINDING OF FACT: <br /> 1 . Lot is zoned residential . Sand, base, fill was placed on property <br /> 14-15 years ago in preparationfor residential use. <br /> 2. Flood Zone Ordinance now requires floor of residence to he at least <br /> 2 feet above flood height and Shoreland Ordinance requires permit for <br /> filling. <br /> CONCLUSION: <br /> The project as planned, with specified conditions; wi l I not result in <br /> substantial detriment to navigable waters by erosion, sedimentation, <br /> impairment of fish or aquatic life, or safe and healthful. conditions. <br /> Motion carried. <br /> #987. Motion by Purcell, second by Kruschke to grant a variance of 36 <br /> feet from required rear yard and 5 feet from required left side yard. <br /> FINDING OF FACT: <br /> 41mir� 1. Odd shaped lot, location of existing driveway and septic system, <br /> and the severe drop of terrain across the lot create problems, make <br /> it impossible to locate the proposed building without a variance. <br />
