Therefore, denial of variance requiring removal of the <br /> silos would not provide needed open space nor substantially enhance <br /> the open-space already existing. <br /> CONCLUSION: <br /> 1. Proven case of unnecesary hardship. <br /> 2. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> Motion by Voges, second by Schwahn to establish a general policy, with <br /> regard to variances from required setback from roads or front property <br /> line, that the pertinent construction will be removed at the owners <br /> expense if future road improvement requires the land for additional right- <br /> . of-way. <br /> Motion carried. <br /> Motion by Voges, second by Schwahn to establish a general policy, with <br /> regard to special exception permits, that sodding or seeding with fast <br /> growing grasses and mulching shall be required on all disturbed areas; <br /> filled, graded, etc. , to prevent siltation or .erosion. <br /> Motion carried. <br /> #973. Motion by Schwahn, second by Voges to grant the Special Exception <br /> Permit with the following conditions: <br /> 1. The bottom of the proposed water-way shall be sodded, with a minimum <br /> width of two feet of sod, along the entire length of the water-way. <br /> The sod shall be staked to prevent wash-out. <br /> 2. The banks of the water-way shall be seeded and mulched as proposed <br /> by plan. <br /> 3. Permit will he effective upon receipt of Mr. Hertzberg's written <br /> statement of approval of plan. <br /> #9H0. Motion by Voges, second by Schwahn to grant a variance of 13 feet <br /> from the required setback from C.T. H. "BB" with the following conditions: <br /> 1 . Garage shall be removed at the owner's expense if future road' improve- <br /> ment requires: additional right--of--way. <br /> 7.
