Appeal by Ray Gilden for a variance from required side yard and <br /> setback from road, as provided by Section 10.12 (6) and 10.17 (1) , to <br /> permit construction of a garage on Lot #4 and SE 3/4 of Lot #5, Block <br /> #30 - Village of Mt. Vernon, 1712 Washington Street - Section 34, Town <br /> of Springdale. <br /> IN FAVOR: R. Gilden OPPOSED: None COMMUNICATION:. Telephone call <br /> from State Highway Department expressed concern about closeness to <br /> highway. <br /> (10, The public hearing was closed. <br /> #938. Motion by Voges, second by Purcell to grant a variance of 7 feet <br /> from the required setback from Webb Avenue. <br /> FINDING OF FACT: <br /> 1. Lot has shallow depth from Webb Avenue side and location of a con- <br /> ventional size garage would be impossible without a variance or <br /> utilization of the majority of the yard for driveway purposes. <br /> 2. Many building in the area are as close to streets and variances <br /> have been granted for others. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #939. Motion by Schwahn, second by Kruschke to grant a variance of 3 <br /> feet, more or less, from required rear yard. <br /> FINDING OF FACT: <br /> 1. Parcel has exceptional topographic problems; land slopes at <br /> 25°-30" down from road, levels off briefly and then drops steeply <br /> down to rear line located in a ravine. The residence is located <br /> in the level area, and back far enough to provide for a useable <br /> grade for the driveway. Actual delineation of required rear <br /> yard line is very difficult. <br /> 2. Ravine and wooded area of approximately 300 acres provide open <br /> space to the rear. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or the public <br /> i n to rn't. <br />
