Motion by Kruschke, second by Schwahn to grant the Special Excep- <br /> tion Permit with conditions: <br /> 1) . Retaining walls or slope of banks shall be designed to prevent <br /> erosion or siltation. <br /> 2) . Excavated and fill areas shall be sodded or seeded with fast <br /> growing grasses, ie: rye grass, which will provide growth be- <br /> fore winter and prevent possibility of fall or spring erosion/ <br /> siltation problems. <br /> 3) . If areas are seeded a mulch or straw protection shall be provided <br /> 4) . Safeguards as prescribed above will prevent erosion, siltation or <br /> detriment to navigable water. <br /> Motion carried. <br /> #931. Motion by Purcell, second by Schwahn to grant a variance of 38.3 <br /> feet from required setback from Haugrud Road. <br /> FINDING OF FACT: <br /> 1. Haugrud Road is only a stub and is utilized mainly as a field <br /> drive. Sletto Road has been made the main road. Protection of <br /> Haugrud Road right-of-way is no longer necessary. <br /> 2. Existing residence was built in 1832, was a pony express station <br /> and is being preserved for historical reasons. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> (100 <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #932. Motion by Voges, second by Purcell to grant a variance is 5 feet <br /> 6 inches from required side yard granted. <br /> FINDING OF FACT: <br /> 1. Structure is only a sun-screen to prevent interference with opera- <br /> tion of machine and is not an extension of an enclosed building. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #933. Motion by Schwahn, second by Kruschke to grant a variance of 30 <br /> feet from required setback from unnamed Town Road and 13 feet from required <br /> setback from U.S.H. 12-18. <br /> FINDING OF FACT: <br /> 1. Existing residence is non-conforming as to setbacks and variances <br /> would be required for any addition. <br /> 2. Addition will be farther from roads than the existing house. <br /> CONCLUSION: <br /> a. Proven case of unnecesary hardship. <br /> b. Variance is necessary to provide right enjoyed by others. <br /> c. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br />
