Page 4 <br /> 4111, <br /> #934. Motion by Voges, second by Schwahn to deny. <br /> FINDING OF FACT: <br /> 1. - a) . Deck was not included in zoning permit for the residence. <br /> b) . Builder did not check with Zoning Department on change <br /> from patio to a raised deck. <br /> CONCLUSION: <br /> Self-imposed hardship. Motion carried. <br /> #935. Motion by Voges, second by Purcell to hold in abeyance until next <br /> regular public hearing date. Motion carried. <br /> #936. Motion by Purcell, second by Kruschke to grant a variance of 3 <br /> feet from required right side yard. <br /> FINDING OF FACT: <br /> 1. Existing cottage is on a 25 foot side lot and is non-conforming <br /> as to right side yard. <br /> 2. Porch addition is replacement of old deteriorated porch and will <br /> not encroach any further into side yard than the old porch or the <br /> residence. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> c. Hardship if caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #937. Motion by Kruschke, second by Schwahn to grant a variance of 4 <br /> feet from required right side yard. Said stoop or deck shall not be en- <br /> closed. <br /> FINDING OF FACT: <br /> 1. Side entry door is existing, approximately 3-4 feet above grade, <br /> and cannot be utilized without provision for a stoop and stairs. <br /> 2. First floor has only the one usable front entry, second entry is <br /> needed for safety reasons. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> c. Hardship is caused by the ordinance and is not self-imposed. <br /> Motion carried. <br /> #940. Motion by Voges, second by Schwahn to grant a variance of 19 feet <br /> from required setback from Woodland Road. <br /> FINDING OF FACT: <br /> 1. Construction is to replace burned barn. <br /> 2. Stantions and milking system were not harmed by the fire but could <br /> not be utilized if barn could not be re-built in the same location <br /> 3. Insurance will not cover relocation of stantions or milking system <br /> if they had to be moved. <br /> 4. Woodland Road is straight and level in this area and barn will not <br /> cause an increased traffic hazard. <br /> Nibor <br />
