Appeal by Richard Danner and Peter Stein for a variance from <br /> required. parking spaces as provided by Section 10.18; (ti). (b)_ - for <br /> an apartment complex on Lot #8, Danner Stein Plat, S 1/2 SE 1/4 - <br /> Section 36, Town of Madison. <br /> No Appearance: Robert Stauber, agent for Danner & Stein, telephoned <br /> Zoning Department and requested withdrawal of appeal. The Town of <br /> Madison Plan Commission and Town Board objected to less than required <br /> parking. Letter to follow. <br /> The public hearing was closed. <br /> #954. Motion by Voges, second by Kruschke to grant the Special Exception <br /> Permit as proposed, with the condition that the banks of the stream/ditch <br /> shall be seeded with fast growing grasses and mulched to prevent erosion. <br /> FINDING OF FACT AND CONCLUSION: <br /> 1. The project is subject to both Department of Natural Resources <br /> and Dane County Flood Zone; required permits have been issued. <br /> 2. Seeding and mulching will control erosion and siltation. <br /> 3. Considering all of the controls on the project there should be <br /> little, if any, detriment to the stream or safe and healthful condi- <br /> tions. <br /> Motion carried. <br /> #955. Motion by Kruschke, second by Purcell to grant a variance of 30 <br /> (11, feet, more or less , from the required setback from S.T.H. 113. <br /> FINDING OF FACT: <br /> 1. Farm has been recently purchased and the barn is just too small <br /> for use. Denial of variance would prohibit functional use of barn <br /> for cattle. <br /> 2. Addition will be in line with the existing barn and will not be <br /> any closer to the road. <br /> 3. The highway is straight and level in this area and the addition <br /> will not be a traffic hazard. <br /> CONCLUSION: <br /> a. Proven case of unnecessary hardship. <br /> b. Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried. <br /> #956. Motion by Voges, second by Kruschke to grant a variance of 8 feet <br /> 6 inches, more or less, from required right side yard and a variance of <br /> 32 spaces from required parking with the following conditions: <br /> a. That the 32 parking spaces shall be provided on the adjacent pro- <br /> perty to the West which is located within the City of Madison and <br /> on which the applicant has a land contract purchaser's interest. <br /> b. That an easement or deed restriction or other guarantee, which win <br /> provide for continued, future, availibility of said parking shall <br /> be submitted to and approved by the zoning administrator or his <br /> assistant. <br /> 1 <br />
