Reduced setback for Mr. Hefty's deck and addition to residence <br /> was provided by variance #459 which allowed a 58 foot minimum <br /> setback from the centerline of C.T.H. "JJ". <br /> 2. The stairway to the deck was not included in variance #459 and <br /> was not included in #459 and was constructed only 56.5 <br /> feet from the centerline of "JJ", a zoning permit was not ob- <br /> tained for the stairway. <br /> 3. The stairway location could easily be changed to provide the re- <br /> quired setback. The bottom of the stairs rests upon the ground <br /> and the upper portion (stair header) is 'nailed to the deck. The <br /> stairs could be moved farther in along the deck without major <br /> problems. <br /> 4. Moving the stairs 1 1/2 feet farther from road would not block <br /> driveway. There would be ample room for a vehicle, approximately <br /> 9 or 10 feet, to pass between the stairs and the residence. <br /> CONCLUSION: <br /> Unnecessary hardship not proven; Motion carried. <br /> Variance #758 Ken Mack, Middleton, was discussed; motion by Schwahn, <br /> second by Purcell (both reluctantly) not to reconsider.
