Motion by Purcell, second by Schwahn to grant a variance of 72 fee, <br /> from required setback from the centerline of C.T.H. "AB". <br /> FINDING OF FACT: <br /> 1. Zoning maps did not disclose right-of-way problem when permit was <br /> issued. <br /> 2. First inspection by Zoning Department did not disclose problem. <br /> 3. Buildings were located parallel to left lot line causing right cor er <br /> of garage to be closer to road. <br /> CONCLUSION: <br /> a) . Combination of errors created hardship. <br /> Motion carried. <br /> #878. Motion by Kruschke, second by Schwahn to grant a variance of 29 <br /> feet from required setback from right-of-way line. <br /> FINDING OF FACT: <br /> 1. Location is within existing farm yard complex, other location would <br /> block access to barn or require the building to be in low wetland <br /> or take up good crop land. <br /> 2. County Highway has an extra wide right-of-way at this location and <br /> does not object to the location of the building. <br /> CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Variance preserves the zoning ordinance as much as possibl: <br /> without injustice to applicant. <br /> c) . Variance is not contrary to right of others or to the publ c <br /> interest. <br /> Motion carried. <br /> #879. Motion by Schwahn, second by Voges to grant a variance of 5 feet <br /> 6 inches from required right side yard. <br /> FINDING OF FACT: <br /> 1. Lots in area are non-conforming in width permitting a 5 foot side <br /> yard. If garage and residence were contained on only one lot, onl•' <br /> the 5 foot side yard would be required. <br /> 2. Garage may not be moved closer to residence because of existing <br /> trees. <br /> CONCLUSION: <br /> a) . Proven case of unnecessary hardship. <br /> b) . Variance is necessary to provide right enjoyed by others. <br /> c) . Variance is not contrary to rights of others or the the <br /> public interest. <br /> Motion carried. <br /> #880. Motion by Purcell, second by Schwahn to grant a 42 foot variance <br /> from required setback from C.T.H. "K". The addition shall be removed at <br /> the property owner's expense if additional highway right-of-way is <br /> needed in the .future. <br /> FINDING OF FACT: <br /> 1. Existing barn encroaches into right-of-way and no addition could <br /> be built without a variance. <br /> 2. Proposed addition will be out of the right-of-way and farther <br /> back from road than the face of the barn. <br />
