Appeal by Philip Kessel for a variance from maximum allowed height <br /> of an accessory building as provided by Section 10.05 (3) (b) - Dane <br /> County Zoning Ordinance. Variance is necessary to permit construction <br /> of a garage at 4721 C.T.H. "M", W 1/2 O.L. #1 Assessor's Plat of Fox <br /> Bluff; Section 5 (So. ) - Town of Westport. <br /> IN FAVOR: P. Motion by Kruschke, second by Schwahn to grant a variance of 1 <br /> 4100' foot 4 inches from required setback from C.T.H. "TT" and a variance from <br /> provisions of Section 10.21 (1) to allow expansion of facilities for a <br /> non-conforming use. <br /> FINDING OF FACT: c :, 1::_ <br /> 1. Addition will be farther back from the road than the residence. <br /> ;.,12. Building has been;utilizied for a._;residence since it was con- <br /> structed which was previous to the C-1 Zoning. <br /> CONCLUSION: <br /> a. Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried. <br /> #866. Motion by Voges, second by Schwahn to deny. <br /> FINDING OF FACT: <br /> 1. Building Plans were altered or changed without obtaining Zoning <br /> Department approval. , <br /> 2. There is adequate area on the lot to have located the building <br /> in compliance with provisions of the Zoning Ordinance. <br /> CONCLUSION: <br /> Hardship was not proven. Motion carried, . <br /> #867. Motion by Schwahn, second by Voges to grant a variance of 3 feet <br /> from the required setback from Woodland Road. <br /> •- <br />
