Sign is as far from intersection and still on applicant's property. <br /> 4). Similar variances in area. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 2). Variance is necessary to provide right enjoyed by others. <br /> Motion carried -.3-0. <br /> #1788. Quackenbush/Harvey to hold in abeyance to allow applicant to resolve <br /> septic location questions. Abeyance not to exceed January 26th public hearing. <br /> Motion carried - 3-0. <br /> #1789. Harvey/Quackenbush to hold in abeyance pending resolution of <br /> subdivision question. Abeyance until December 22nd 1988 public hearing. <br /> Motion carried - 3-0. <br /> #1790. Quackenbush/Harvey to grant with condition. Variance of 12 feet more <br /> or less from required setback right-of-way STH 113 to permit addition to <br /> existing mini-warehouse. <br /> CONDITION: <br /> Addition to be removed at owner's expense if future road improvement requires <br /> additional right-of-way. <br /> FINDING OF FACT: <br /> 1) . State Highway has very large right-of-way. <br /> 2) . Property is bounded by road right-of-ways on 3 of 4 sides. <br /> 3). Town Board in favor and no objection from State Highway. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> #1791. Quackenbush/Harvey to grant with conditions. Variance of 1 feet more <br /> or less from required left sideyard, 1.9 feet more or less from required right <br /> sideyard to permit porch addition to existing residence also variance of 75 <br /> feet more or less from required setback to normal high watermark to permit <br /> steps and observation platform as proposed. <br /> CONDITION: <br /> 1) . Neither right nor left sideyard variance shall allow proposed addition to <br /> extend lines of existing building. <br /> 2). Steps and platform shall be constructed in such a manner as not to <br /> require Special Exception Permit. <br /> FINDING OF FACT: <br /> 1) . Proposed porch will be constructed over existing deck in need of repair. <br /> 2) . Steps and platform also exist but have deteriorated to point of being <br /> dangerous. <br />
